Hey Attorney General, How's that Separation thing workin' out for ya?

June 2010 Elderly Affairs FundRaising letter

The latest Elderly Affairs fundraiser letter has arrived in our mailboxes(see the link above). And it is obvious that there STILL isn't any separation between the PD, Elderly, and the APCF.

This mailer is supposedly paid for by the APCF, but contains "important message from your Police Chief, and Elderly Affairs Director"

Here are the problems:
In the "Daily well being call" section:
"Call into our dept.362-5536(PD phone number) and let us know you are alright. If there is no response to our call we will send an OFFICER out to make sure you are ok."

APCF has no authority to send a police officer anywhere.

In the "Medical Equipment" section:

"If you should need any medical appliance, please call us at 362-4001(PD number) before you buy any,At the Police Station we have (medical equipment) We will deliver them direct to your home"

All this equipment was donated to the TOWN for the use of the elderly, the APCF, has no authority to deliver any of it.

The Elderly Affairs Donation Drive Section:

"The Elderly Affairs dept. is currently conducting our annual fundraising drive.......We could not continue to provide assistance to our seniors without the residents generous donations to the Atkinson Police Charitable Fund"

The Elderly Affairs Dept. has a $37,000 budget and will continue to provide services to our seniors with or without donations to the Private APCF. Here we have the use of a town depts. name to fundraise for a private charity. Also the town does not show these donations listed in this mailer from APCF to the Town. apparently someone is lying here.

We paid $5k to separate the PD and the EA, plus the increase in the EA budget. The Chief argued that the EA services would cost more if separated from the PD and they could not fuction without the PD.

Well, it's still one big tangled web of misappropriation and abuse of taxpayer funds and a scam.

Now, one person is managing THREE budgets, one of them private and there is no oversight, no control, no accountability.

Yes, I like the part where it says the elderly affairs department is conducting it's annual donation drive...send your money to APCF.

What would happen if I were a Town official who used my town office to raise money for a private non- profit corporation that I controlled?

I would think the voters would see me as corrupt and drum me out of office, and THAT would be if I were lucky enough not to be taken to jail.

We are to live with this? The selectmen. This looks bad that they approve of this.

I feel so sorry for them and my town. I feel humiliated myself.

Why can't the Conflict of Interest committee meet and resove this? This nasty conflct is their responsibility to work on. That's why I voted them into office. They need to meet and protect the town.

While you're probably sick of hearing about Atkinson Elderly Affairs Dept., it is crucial that you read this letter. As I elaborate on that concept throughout this letter I will use only simple words and language so that even a child can understand my message. Yes, even a child should know that to someone whose eyes are open, Atkinson Elderly Affairs Dept.'s constantly repeated mantra that it is a spokesman for God is an insanely illiterate notion. By way of contrast, consider my personal mantra that Atkinson Elderly Affairs Dept. accuses me of being impolite in my responses to its ribald rodomontades. Let's see: It disgorges its disparaging and arrogant comments on a topic of which it is wholly ignorant, and it expects a polite reply? What is it, yellow-bellied?

On the issue of unilateralism, Atkinson Elderly Affairs Dept. is wrong again. Sure, its behavior is beyond prurient. But if Maoism were an Olympic sport, Atkinson Elderly Affairs Dept. would clinch the gold medal. Let's look at the facts. First, Atkinson Elderly Affairs Dept.'s imperium is reminiscent of the French Jacobin Club and its morbid obsession with power, death, and demagogism. Second, Atkinson Elderly Affairs Dept.'s idea of addressing a problem is not to fix the problem but to establish a task force, council, or commission to look into it, study it, dissect it, and finally talk it to death. And finally, Atkinson Elderly Affairs Dept.'s claim that our unalienable rights are merely privileges that it can dole out or retract is factually unsupported and politically motivated. Atkinson Elderly Affairs Dept. wants to use scapegoating as a foil to draw anger away from more accurate targets. Such intolerance is felt by all people, from every background.

Whenever Atkinson Elderly Affairs Dept. announces that its accusations are good for the environment, human rights, and baby seals, its cheerleaders applaud on cue and the accolades are long and ostentatious. What's funny is that they don't provide similar feedback whenever I tell them that Atkinson Elderly Affairs Dept.'s subordinates tend to fall into the mistaken belief that a totalitarian dictatorship is the best form of government we could possibly have, mainly because they live inside an Atkinson Elderly Affairs Dept.-generated illusion world and talk only with each other. Please keep in mind that I undoubtedly feel that we should shift our focus here to the role of environmental and situational factors in triggering the maladaptive and violent behaviors that Atkinson Elderly Affairs Dept. exhibits whenever it attempts to destroy our culture, our institutions, and our way of life. It is disgraceful that, with a wink and a smile, Atkinson Elderly Affairs Dept. has signified its approval of noisome, Pecksniffian couch potatoes who make mountains out of molehills. Of all the delusions I have ever known, the most shambolic is the idea that five-crystal orgone generators can eliminate mind-control energies that are being radiated from secret, underground, government facilities. Still, that doesn't prevent Atkinson Elderly Affairs Dept. from keeping us everlastingly ill at ease. Atkinson Elderly Affairs Dept. seeks scapegoats for its own shortcomings by blaming the easiest target it can find, that is, impulsive social outcasts. If Atkinson Elderly Affairs Dept. honestly believes that some of my points are not valid, I would love to get some specific feedback from it. In closing this letter, let me point out that I would be remiss if I didn't remind you that I must doubtlessly reach out even to my most ostrich-like readers and show them how no matter how much Atkinson Elderly Affairs Dept.'s précis are rationalized, they still retain an institution which, twist and turn as you like, is and remains a disgrace to humanity.

i DID file a conflict of interest committee complaint about this very same type of abuse.

The result was that the Chairman, Mr. Hazlett refused to consider it, claiming it to be inaccurate even before investigating it, he then resigned the next day.

In my complaint I asked for Mr. Sapia to recuse himself as he was co-plaintiff with the chief in a lawsuit against Artus et al., He claimed he was not involved in any litigation, a patent lie as I had the Court documents, he subsequently resigned.

And the Chief came into the meeting with a 32 page dossier on a third member of the committee, Mrs. LaFrance, claiming that she had filed complaints against him in the past and therefore had to resign, which she did.

Now there is only Dick Smith left on the committee, and he is powerless to do anything on his own. My little complaint, which SHOULD have been dealt with impartially, blew up the committee.

Mark, the Chief did not ask me to resign, he asked me to recuse myself because I complained about him. I believe it was really because I was one of the people who witnessed the Dispatcher doing work for the charity.

I resigned because the committee could no longer function after Jim and Jack resigned, because I have been having health problems, and because I tried to contact the BOS to ask permission to consult the Town Attorney and they ignored my calls.

I wanted to get legal advice on how to get new board members and I believe we needed to petition the court to do this.

Anyone who knows me will confirm that I would have been very objective in evaluating the facts, had the petition been heard. I was the only one on the committee who was asked whether I met the juror's standard, though other committee members engaged in behavior that raised my eyebrows.

BTW, I asked for the 32 pages under RSA 91A, but they would not give it to me. The TA said they don't have it.

but, knowing people like all of you are out there i'm sure it wont.

Just wait; when your 75 years old and need a ride because your family wont help you, you'll be wishing the police dept and elderly affairs are there for you.. so sad

Spinning the debate to avoid the issue is not an argument.

The fact is that there is a clear conflict of interest here.

This violates town ordinance. It also skirts very close if not violates state law, in my humble opinion.

Chief asked me a few months ago, about my contention that there was a conflict, my comment to him was as follows;

"Chief, if I were in your shoes, I would have turned over the donation acct. to the trustees of the trust funds, as the Ag first asked to be done. BUT, assuming that for whatever reason, I actually took the path that you did; I would have set the charity up with an independent board of directors, unattached to me in any way. I would have no control, or any part of the charity, much as I did with the donation acct. I set up when Vic Richards died. And when a request for service came to elderly affairs, I would say, Mrs. Smith, I understand that you need help with your heating oil, and here is the name and number of the director of the Charity, please call him to see if they can help. Then I would forward an email to the director advising him of Mrs. Smiths call.

All legal, above board, and without conflict, and a paper trail to prove it.

Tell me; would those of you defenders of this action feel the same way if any other private charity was telling it's donors that they would have Atkinson police do anything for them?

How would you feel if ACORN mailed fundraising letters to the town, promising police services, in return for donations?

What is the difference? Don't get caught up in the spin, look at the facts, the ownership, and the control.

it appears that there will be no one who will try to be a member of the conflict committee unless there is no reason of fear of reprisals. The only other remedy is the courts . Why not try to have a look at that as a remedy for all the accusations by forcing the A.G.'s office to help make the case go forward to make the wrong doers disappear once and for all. That way there will be very few if any persons in fear. Part of the application could ask the court to put the blame on the opposition as it were if there be any problems of reprisals. just a suggestion and thought.......















it would appear that there will be no more new members of the conflict of interest committee until fear of reprisals are long gone

What is sad is people who have family but are ignored. They have to resort to getting help from the scum bags who run this town rather than their own family. You know the type of so-called family, they go along with the scams because they do business with the corrupt townies and they don't want to rock the boat. Rock the boat, lose customers. Oh, and there's the other lame argument, 'It's for the kids!'. Yes, people use this when taking about the PD and the EA. Spare me.

The boat is sinking, go home and take care of your own family so that others do not have to.

It's refreshing to hear some intelligent observations on an issue that, while beaten to death on this blog, has not be expressed in quite the same way as your precis. I would opine the narcissistic personality disorder (NPD) on display by our award winner is the primary root of the problem. The posse comitatus merely mimicks the tactics and behaviors which you see repeated throughout town leadership. For example, "attack the messenger", "you have a vendetta" and other crude but, sadly, effective methods play to an audience that reminds of the the three monkeys; hear no evil, see no evil, say no evil.

Truth is stranger than fiction in a town where disgusting intimidation tactics are allowed to continue because the majority voting block are influenced by a liar giving away free trinkets. Our vote is our most sacred possession but it's sold for a free ride or other obligation.

Only in Atkinson where the truth is suppressed, leadership follows a narcissist with a badge and votes are for sale. What a pathetic group of small minded, so called leaders.

Or are the rest of the residents to blame for being distracted or apathetic? Where does the fault lie?

To answer that I look to the last people to stand up to this guy... one had his house and car vandalized, and the police chief, instead of claiming they wont tolerate this, and will catch the perp, smeared the victim.

Another was driven from town with death threats.

So how many do you think will speak thier minds about Phil's immoral behavior?

This very well be for the reason I received my degree 6 months after I finished my last class. Degrees, in my case, are handed out once a year.

I had a letter from the school declaring I was done and I would get my diploma and and that was good enough to get my first job though officially I did not have the degree yet.

I wouldn't read anything into it.

I am disenchanted by the fact that it took so long, that he weasled the town out of extra pay during the last deployment and that he was getting paid while on his two week guard training.

I do not like the dishonesty that infests the police and town departments.

What are you talking about extra pay? For what? And is it true he has been "working on this degree" for 9 years? to get a four year degree?

I don't know if it is 9 years or not, but I do know that he has been working on it for quite a few years. He and I spoke about it on election night 2006, I think, and he had about 55 semester hours then.

As to the extra pay, that happened in 2003. Billy was deployed to a ship in the persian gulf, although he spent the first couple of months of his deployment in Boston.

Selectman Boyle proposed advancing Billy $5,900.00 so that he would not suffer a loss in pay. The BOS asked for his Leave and Earnings statement to figure out the difference between his town pay and his military pay. Billy instead gave the town a "commanders base pay" letter, which only reflects his base pay, not his reps. The Board demanded the pay stub(LES) or the return of the money. At the same time chief was accusing the board of nickel and diming Billy, claiming that the difference was $511.51/WEEK! It wasn't! It was $400.00/month!

You can see this in the minutes from May/June 2003.

It's against town policy. That's who SHOULD care. We know the guy who signed off on it doesn't care.
