Atkinson officials question air-quality woes at station

ATKINSON — Selectmen are questioning whether there are any air quality problems at the police station, after months of delay on the planned project to clean out air ducts.

Earlier this month, the state Department of Labor did a safety audit and found the air quality in the police station was "poor." The state gave selectmen until Jan. 13 to come up with a solution to the air quality problem.

But now selectmen are fighting back against the state mandate, saying there is no problem. Selectman Craig Schuster said the state has not seen some of the testing data.

"There's some data out there stating the air quality was satisfactory," he said. "That hasn't been verified yet. Until I actually see the data and the testing we've done, I question it."

Police Chief Philip Consentino said he can't believe selectmen are now doubting the poor air quality, which wasn't contested before.

"They've had two or three people the town paid to come in and do air quality tests," he said. "Why did the town put out a request for bids if there is no problem?"

The air quality issued was addressed in the independent Municipal Resources Inc. report from September, which analyzed every aspect of the police department. The report said there were three types of mold and fiberglass particles in the air at the police station, caused by water damage from the leaky roof. Selectmen said the air ducts would be replaced over the summer, but the project stalled.

Earlier this month, Selectman Fred Childs said the delay was caused by two bids from contractors that were much higher than the town estimated — almost $45,000.

But Schuster said the issue isn't the price, rather it's the existence of any problem.

"You hear reports from the police department saying they're having issues and people are sick, but we did testing and didn't find anything," he said. "We need to take a step back and find out the real information, then attack the issue."

Consentino said selectmen already have done some work to improve the air quality. They had the air return over the dispatcher's desk replaced and had all the ceiling tiles taped up to prevent particles from circulating.

"The tiles had stains on them from the rain and were turning moldy," he said. "How can they say it's fine? We've had expert upon expert brought in and right now I've washed my hands of it."

Schuster said the town put out initial RFPs with a plan to go up into the attic of the building, clean the ducts and explore what was going on in the ceiling of the station.

"Part of the RFP was looking into what we could find," he said. "But nobody wants to do it. If there is a problem, we will fix it. The timeframe will depend on how big the issue is."

Schuster said selectmen plan to hold a workshop to verify the data and find out what the real issues are at the department, before starting work.

Consentino said he's just waiting to see what the board will do.

"The Board of Selectmen is in charge and, hopefully, they'll realize something has to be done," he said.

Until then, Consentino said, he bought an air purifier for the dispatch office on Tuesday, to keep his employees happy.

There is no air quality problem at the police department, testing proved that. The mold is the same old mold that is floating around in the air everywhere, and insignificant. No fiberglass in the air at all.

This is not an air quality problem; this is I want a new police station by the Conman.

All at the APD have seen the testing results showing that the air quality at the is fine. They are either too slow to understand the results, or they are being pressured by the conman to continued complaining.

Solutions:

Immediately buy a box of masks at a hardware store and insist that they wear them.

Move the females to the Community Center to dispatch.

Close the APD disptach, go with Plaistow. It only seems to affect the two females.


Ask for them to present medical evidence to show that they have had damage to their lungs done by the air at the police station.

This is just another scheme the conman to create a bogus problem and then set out to get more of the taxpayers money to solve the problem.

Consentino is nothing but a BIG DARK HOLE INTO WITH TAXPAYERS POUR MONEY INTO. Want to save a LOT of Money? Dump Consentino into his own hole.

The person who said to supply them with masks had a good idea. I would wear one if I thought there was a problem in the air. In fact I wouldn't work there if I thought there was a problem in the air.

why not have the selectmen work out of the PD for a week? If they get sick, fix the problem. If they don't, fire Consentino for trying another one of his false reports!

"We did it to give diversity to the board and just for simple math," he said. "On a board of three, all it takes is one dominant selectman and one weak selectman who becomes a puppet, and you've basically got a mayor."

O'Neil said he campaigned to put the warrant article together, getting more than 100 signatures to support it. Last year, a candidate for selectman proposed a return to a three-member board, but that measure failed. O'Neil said that proved the change was positive.

"I feel this was the best move for the town," he said. "I would definitely recommend it to towns to explore. Every town would have different issues and reasons why, but I think moving from three to five is better."

Another benefit to five Selectmen is if one's out sick or working their real job or has a family and is too busy then it's no big deal if one or two of em doesn't show up. Town business proceeds. I'm liking the idea.

Phil's budget is loaded with extra unnecessary padding. He can always sell off a few cars to raise cash. How many cars now 15? I'll give the budget comm credit for cutting some Phil pork. They have more work to do.

I read the LET article. It seems our FD has no problem using the free community service help. But its a brilliant new idea for the PD? come on it was Phil giving out goodies of easy OT to pick up the trustee as a favor to his comrades just like everything else. It comes as an obligation with loyalty and votes expected in return.

6:02; Phil, no one is trying to cut off the Elderly. Trying to make the program HONEST, ACCOUNTABLE, and TRANSPARENT is a noble goal, Although it is understandable why you have fought these efforts so diligently. If only you could apply such diligence to the administration of the police dept, Atkinson would not be a laughingstock in the NH Law enforcement community.

Did anyone catch the personal information he gave out on the tragic accident yesterday? He made up most of the stuff about the husband's situation. He will always comment on anything, even when he actually knows nothing.
The comments he made were self serving, showing how compassionate the EA Dir. is. Not.

When is the ET going to start talking to Sgt. Caggiano and avoid the 1/2 truths from the conman?

The state did not find a problem with the air quality at the police station. This is conman lying again.

An employee at the police station complained to the state investigator about the quality of the air. The state person was in town on a regular review of what might be safety issues.

The state report reflected that. Just said that an employee complained. There was a list of safety issues.
The town has corrected a lot of them and will respond to the state if the town feels that an issue on the list is invalid.
That is what they will do about the PD air.
When are we going to shut the PD down? That would save us money we could use to buy fuel for the elderly.
What do you say to that chief? Let's trim down your budget and buy heat for the elderly.

No ones believes there's a problem with the air, other than maybe a dirty building. If they had a trustee 3 to 5 days a week, why so much dirt? The Chief has gone public to commend the trustee on his wonderful work, so what is really going on here? You can't have it both ways.

You so funny 11:52 AM. If town officials would just aquaint themselves with State Law, especially the new changes, and follow the rules, there would be no drama and fighting. Sadly, everyone wants to be the town's big daddy and that's not how it's supposed to work.

Tim you are 100% correct that the wording of petition warrant articles can be amended at deliberative session. You are also 100% correct that the claim that 2011 House bill 77 forces petitioned warrant articles to go straight to the voters without changes in wording is 100% wrong.

However you are making a common mistake when you say that the “intent” of a warrant article must be retained. I suggest you read “Petitioned Warrant Articles New Hampshire” published in Town and City, February 2004. http://www.nhlgc.org/publications/item_detail.asp?TCArticleID=210

From that article: Question: Can an amendment change the intent of the original warrant article? Answer: Yes. It is important to keep in mind the difference between “subject matter,” on the one hand, and “intent” on the other.

2011 House bill 77 added the following words to RSA 40:13 IV “No warrant article shall be amended to eliminate the subject matter of the article. An amendment that changes the dollar amount of an appropriation in a warrant article shall not be deemed to violate this subparagraph.”

In March of 2008, Grant v. Barrington, 156 N.H. 807 established that a warrant article can be amended to eliminate the subject matter of the article. That meant that it was legal to amend an article to the following words “To see if the Town will”. 2011 HB77 was written to over-turn case law resulting from Grant v. If you read Grant v. Barrington, you will find references to case law dating back to the 1800s that establishes the right of voters to change the intent of a warrant article provided that the subject matter does not differ from what was in the original warrant. The principle established in the 1800’s, and still valid today, is that the warrant serves to “warn” the voters of the subjects that will be deliberated on and voted on at town meeting. Amending an article to the point where a “new” subject not “warned” in the original “warrant” undermines the purpose of posting the warrant in advance of town meeting.

Many voters would probably agree that changing the intent of a petitioned warrant article is unfair to the petitioners. But presently, it is perfectly legal to do so. In May of 2011, and after adoption of 2011 House bill 77, there was a superior court ruling on a claim of a violation of the wording added to RSA 40:13 IV by 2011 HB77 (Bailey v. Exeter, Rockingham County Superior Court No. 2011-CV-203, 5/27/2011). The superior court’s ruling seems to exceed the authority of 2011 HB77. But the superior court’s ruling was not appealed to the NH Supreme Court so the ruling does not establish “new” case law. Until a similar case and ruling makes its way to the NH Supreme Court, it remains legal to change the intent of a petitioned warrant article provided that the subject matter does not differ from what was in the original warrant.

Right after the law went into place some morons in Exeter challenged it and changed the words of a warrant like you suggest. The town of Exeter got sued by 11 citizens as a direct result they felt HB 77 was violated.

January 4, 2012 5:48 PM it sounds like you threatening to sue the voters of Atkinson if they exercise their legal right to change the wording of a petition warrant article you intend to submit.
