AG's office: Police funds must follow the law Oversight of donation accounts must change

ATKINSON — The Police Department's donation accounts have been the focus of a four-month investigation by the state attorney general's charitable trust unit.

The results are in: The money needs to be handled differently.

The investigation was spurred by complaints from residents to the attorney general's office, according to Terry Knowles, assistant director of the charitable trust unit.

The accounts — the police department equipment fund and the senior citizen donation fund — have long been fodder for debate, controversy and lengthy posts on two local blogs.

Police Chief Philip Consentino, no stranger to controversy in his job and in his previous seat on the Board of Selectmen, has defended the accounts and his handling of them. He could not be reached for comment yesterday.

But the state isn't suggesting any wrong-doing, rather ignorance of the law regarding such accounts.

"To be perfectly frank, not everyone understands how these funds work," Knowles said. "I think the town will be cooperative and perfectly reasonable about this."

Her office sent a letter to Consentino and selectmen Friday — and another will be sent out shortly.

"The town cannot hold charitable funds unless all activity and funds are held and reported through the trustees of the trust funds report," the letter states.

The two accounts are funded through donations, Consentino said previously. The money is used for police equipment purchases and senior citizen assistance, he said.

In 2007, $23,279 was donated — and $34,168 spent — to the Police Department donation account, according to the town report. Another $15,000 was donated to the senior citizen donation fund last year, according to Consentino's annual report, but there is no specific accounting of that fund in the town report.

Consentino does know how to raise money. In 2007, voters approved a warrant article appropriating $5,649 a year for four years to purchase a $43,000 wheelchair van. Less than a year later, Consentino announced he had raised $37,000 for the van through donations and would only need the first year's appropriation of the four-year warrant article.

Selectman Fred Childs said yesterday he doesn't think the town is doing anything wrong. Every time Consentino wants to take money out of either account, selectmen hold a public hearing. Childs said he can't remember anyone ever coming to a hearing and objecting to an expenditure.

So far this year, Consentino has withdrawn about $13,000 from the two accounts. Money went toward a cruiser camera, electric bills for senior citizens, flowers, and postage, among other things, according to selectmen's minutes, which are published on the town Web site.

On April 7, Jodi Consentino, the chief's wife, went to selectmen to ask for money from the Police Department's donation account to sponsor a baseball team. That's the one item selectmen voted on, which they passed unanimously.

Otherwise, selectmen just vote to open and close the hearings.

Selectmen Paul Sullivan and Bill Friel did not return phone calls yesterday.

Childs said other municipal departments receive donations — the Fire Department, library, Recreation Department — but it's only Consentino's accounts that are questioned.

"But it's just Phil's (accounts) that people seem to have a problem with," he said.

Now that the issue has been raised and investigated, the town has two options, according to the attorney general's office.

The town can form a nonprofit group to handle the accounts or it can turn control over to the trustees of the trust fund, Knowles said. If the town goes the nonprofit route, selectmen will have to establish a board of directors to oversee the accounts, she said.

Childs said yesterday that he hadn't seen the letter from the state and didn't think the other selectmen had either. But he did say selectmen likely would discuss the issue at their meeting Monday at 6:30 p.m. at Town Hall.

Apparently what the AG's office failed to realize is that there are more than the two accounts.

And that the elderly donation account that the Town manages is set up for small donation under $500 or so, and is only used for donations that the donor earmarks for seniors only.

Wonder what the Ag's office would say if they found out that there was another mysterious account, that the selectmen have no control over, that never holds a public hearing for withdrawal, that has no oversight, that raised God only knows how much money last year, and donated $21,000 to the wheelchair van, exclusive of the $17,000 coming out of the donation account.

How can it be verified that the elderly donation account that the Town manages is set up for small donations under $500 or so?

How do you know there's another mysterious account, that the selectmen have no control over?

This type of information is critical to the investigation.

The AG will be sending another letter to the Town next week. It will be posted on the Atkinson Taxpayer's site when it is received.

I would like to know why the Trustees of the Trust Funds committee allow this to continue? They oversee the other funds, why not the PD accounts?

Our chief law enforcement officer ignorant of the law. Give me a break. If the AG knew half of what goes on in this town they would figure out it is not be a case of ignorance but rather disregard of the law. This forum has gone into great detail the laws the chief believes do not apply to him. Yet he gets away with it time and time again. Completely unbelievable.

We can take some satisfaction in that the chief is well versed in postal regulations.

Here is the basic problem; even with the one acct. everyone knows about the one that the selectmen have public hearings to withdraw from, there is STILL no accountability!

Chief comes in and asks for a withdrawal for X,Y, and Z.

Selectmen close hearing. No Vote to spend money they just sign whatever voucher chief submits.

Problem is that vouchers don't always match what he said in the meeting.

In 2007 Chief requested withdrawals of $10,484.00 that was never spent. GREAT!

But...

$1,946.48 was spent that was never requested in a public hearing.

Contrary to what the chief wrote to the AG the police donation acct. is NOT AUDITED by Mason and Rich because it is an OFF BUDGET acct.

Also the only acct. that the town has anything to do with is the police donation acct. and the VERY SMALL PD senior donation acct. Which spent $74 this year.

Now follow me along for a moment... Take one transaction The wheelchair van everyone knows that the chief did an admirable job of fundraising to raise $37,000.00 towards the purchase, only $5,000 came from the taxpayers. The problem is that only $17,000 came from the police donation acct. The other $20,000.00 was fundraised outside of this acct. and never was touched by the town bookkeeper.

So where did this money come from who held it who raised it who wrote the check to Ride-Away, who controlled these funds where were they deposited and who was the LEGAL TRUSTEE of these funds?

Not all the letters were posted on the Taxpayers site. The response from the AGO to the PD is missing. It's dated 7/18 and they should be putting it up there soon.

Look, My fellow Atkinsonians,

NO STATE AGENCY is going to reprimand a town official like the chief for wrong doing.

They will proscribe a course of action moving forward, but they do not punish, and why, you may ask?

Because THAT IS THE SELECTMEN'S JOB! The selectmen have the authority to hire, fire, and discipline employees, no one else!

We have a 4 step discipline procedure in town, the fact that the selectmen are unwilling to enforce it in these cases, is their fault, not the chief's, or the state's.

There is an article on here that lays out a 30 year track record, each of those incidents, in my opinion were discipline worthy, yet, here we are.

This is not the state's problem, it is our failing.

Well i see the apd withdrawl this week was only just over 1,060.00 for some flowers and a new vacuum cleaner for the police dept. And also for some other stuff not detailed. That must be one hell of a Vacuum! I wonder if it has red flames painted on it?

I guess my question would be...

From an accountability standpoint,

What is the point of holding a public hearing, if what we are told the withdrawal is for at the hearing, doesn't match what is ACTUALLY withdrawn?

It is all just smoke and mirrors, basically a slush fund as one budget committee member referred to it, when I served.
