ATKINSON — Police Chief Philip Consentino said selectmen are threatening to fire him for doing his job.

Consentino had heart surgery on June 14 and had been doing some work, mostly paperwork, from home while he recovers. But in a letter Consentino said he received on July 12, selectmen asked him to stop doing any police work.

"While you are out recuperating from your surgery, you are instructed that you are not authorized to perform any of your duties as a police chief or elderly affairs director of the town of Atkinson," the letter read. "Performing any of your duties ... you will be subject to disciplinary action up to and including termination."

The letter was a shock, Consentino said, and he doesn't understand why selectmen would threaten his job.

"I have to get a letter like this to throw all this added stress on my recovery," he said yesterday. "The feeling I got in my gut after receiving a letter like that, it just turned my stomach."

But Selectmen's Chairman William Bennett said the town is not trying to keep Consentino from his job.

"Some people think we're trying to push the chief out and that's in no way, shape or form what we're doing," he said. "The standard phrase in administrative letters is 'disciplinary action up to and including dismissal.' It doesn't mean we're trying to fire him. It just means he has to listen to what the Board of Selectmen tell him to do."

In fact, Bennett said, he wants to get Consentino back to work, but it's a liability issue.

"We want him back in the saddle as fast as possible, we just don't want him to push himself and come back too soon," he said. "I know Consentino, he thinks he's invincible. I don't want him to die on the job and his wife sues us for letting him come back to work."

But Consentino said he has a note from his doctor, saying he is recovering well and ready to work.

"My surgeon stated I could go back to work doing light duty at the Police Department behind the desk," he said. "The selectmen rejected that and said I will have to come back in full capacity, and have my doctor sign off on the physical demands for the Atkinson Police Chief."

The selectmen's letter said Consentino would have to be able to lift 25 pounds, carry more than 50 pounds, and be able to twist, bend, crawl and kneel before he can return to work.

"I'm hoping my surgeon will give me the OK to go back to work by Sept. 1, with no restrictions whatsoever," he said. "But why don't they just let me go back to desk duty? They're just restricting the police department's ability to function."

Town Manager Phil Smith would not confirm whether Consentino had presented his doctor's note and been rejected.

"The chief himself would have to release to you his medical documents from his doctor," he said.

Bennett said the letter to Consentino was a slight mistake. The chief does not need to be able to perform those specific physical activities before coming back to work, he said.

"We need to know if he is pain-free enough to make good decisions," Bennett said. "If he comes in and does desk duty, we don't want him jumping into the fray when he's not ready. It's a stressful job."

Three days after his surgery, while still in the intensive care unit, Consentino said, his wife brought him police paperwork and he would sort it out.

"When I finally got home from rehab, I was paying the bills here and sending them to Town Hall," he said. "Now, I get this letter saying I can't do anything. I have totally divorced myself now from the police department. The department is going to suffer dramatically because Detective (Philip) Farrar is not in a position to make decisions that a chief would make."

Selectmen did not appoint an acting chief while Consentino is out. Farrar was named officer in charge when Consentino left for his surgery.

Consentino said he feels persecuted and singled out by the board.

"(Fire Chief) Mike Murphy was out for surgery two months ago," Consentino said. "I called and asked if he was required to send in a note. He said he was surprised because just three days ago, the town had called and asked for a note from his doctor, which was about two months after the fact."

For now, Consentino is focusing on his health and not working for the town.

I think they have to consider the ramifications of letting him work while recovering from sickness. Maybe there are liabilities or questions about pay due so until he's released, no working for the town.

I believe the Selectmen made the right decision regarding Phil. Without a definitive note from the doctor clearing him to return to work, he poses a rather large threat to the town. He's had heart problems for years...first a pace maker, then a leaky valve, and he's over 70!

Don't blame him for being p.oed, but the Selectmen, for a change, are looking out for the best interests of the towm.

I agree w/the BOS. Having a part time police chief who is over 70 years of age, and just had heart surgery, return to work even desk duty is irresponsible. Police chief can be a stressful job. Phil should put his health first & stay home until fully recuperated. Maybe it's time for Phil to retire and Town of Atkinson to get someone younger, in good health, and able to work full time. This town has grown & it's time to have a full time chief not a part time one.
Also for his doctor to allow him to return to work so soon, even desk duty, makes me question the competence of this doctor.
People, support the BOS in this decision.

Thanks to the Coalition of New Hampshire Taxpayers for assisting the Board of Selectmen with current town policy. The letter was most effective. However, there is a CNHT concern that pertinent documents were removed from the APD file cabinets. CNHT supports the Atkinson selectmen in the immediate return of all documents and files with no redactions or corruption of data.

I cannot believe that Jody Consentino was allowed (did she ask permission?) to remove any paperwork from the PD. Just because she is married to the Chief (nepotism) she has no right to remove anything. Who ever heard of such nonsense and what a couple of control freaks! They should both be fired and sued.

My first guess as to what he might be working on is what is he trying to hide or what information is he trying to grab out of the PD while MRI is there?

BTW, he should not have 2 town vehicles at his house while he's not on duty, but sure enough, he does.

Three days after surgery he was doing paperwork in the ICU? No way. My family member who had open heart surgery was out of it for days. The last thing one would care about is working, not to mention the fact that the doctor would never allow this. This is highly unlikely and improbable.

I think he's mad because MRI is here. Right after we heard they were coming in, off he goes to the hospital. I can't heelp but wonder at the timing and if he knew he should have this surgery then figured this was a good time to do it.

He's probably sitting in bed redacting the police logs and shredding whatever he can.

The town is a mess and out of control. We have a disfunctional PD and the board doesn't do anything about it. How long is this going to drag on and how much are we going to have to pay before someone puts a stop to it all? He should be fired for going to the paper all the time and having all these crazy stories published when he does get his own way. Very immature and unprofessional behavior coming from the so called head of law enforcement in our town. Very sad that he has his friends and relatives in town jobs keeping him there.

Paperwork was transported from the police station to ICU when Consentino woke up from major surgery? That musta been some important papers. But who improperly took PD documents from the police station to the Portsmouth hospital ICU.

BOS, put a stop to the improper removal of official documentation from the police station. If there is a lawsuit and the judge ever learns ANT official documents were removed, he will throw that case out of court. You get the liability, numskulls?

If you stand back and read these issues and the comments defending both sides, it becomes very easy to note that those who are defending the police chief and his questionable ways, usually resort to attacking other people since they cannot defend him in any logical fashion.

There is no logical defense here. The Selectmen are in charge of all Town employees and they have instructed the Police Chief to stop working until he is fit to return to work fully. That this should end up in the newspaper and debated in any way, is ludicrous and stupid. None of this would be debated if we were dealing with a person of sound mind and body. Those in charge have ordered this and it's legal, prudent and wise. Just do it and shut up.

Phil Consentino is a washer/dryer salesman by trade, no FULL TIME police academy, elected because he turned the Police Department into a cab service for the elderly, a nice thought but not the duties of policeman, hired not only his wife but son to work for the department, his working from home is more of a fear that he is not needed than a need to do the job. Sears had him retire maybe it's time for Atkinson to do the same. The 21st century is upon us maybe the washer salesman needs to stay home and take care of himself and his family.

The above post is proof of why Atkinson can not afford to wait any longer. Ignorant thug bullies in office must be dismissed to protect the safety of the innocent citizens of Atkinson. The professional bullies do not know the laws, lack training and violate laws (and the Constitution ) and then proceed to hunt down and violate citizens who expose them. They are a danger to the people. It is only a matter of time before there is an escalation and Atkinson makes the National news.

They are a serious legal liability and increasing amounts of taxpayer money must go in the budget to defend them. LGC is the last chance Atkinson has to retain any liability insurance. When LGC gets the message and drops the town, Atkinson will have no liability insurance.

Next years Citizen Petition Warrant Articles will make it to the eyes of the voters uncorrupted. This year citizens will get to vote on them as written. The State of NH will now longer allow political hacks to rewrite them EVER AGAIN into meaningless junk. The thug Moderator of Kingston, Chairman of the Board and lawyer by trade...He tried it and the court ordered Exeter to DO OVER AGAIN their entire Deliberative Session. And Exeter had to pay the court costs.

It's no secret that you dole out services only to those who are on your email list while ignoring the rest of the residents. This, as you attempt to discredit residents who rely on your department for services they pay for, is despicable and evil. You are hiding the crime in this town and you are using your official position to oppress and bully others. I think it is high time you retire before someone out-thinks your strategies and takes you to court on criminal charges. Ok, I think the comments to this article have passed the borders of the realm of Sanity, long ago.

Where, EXACTLY, did this story of moving files form the PD? Is there an credible evidence of such? And does this include the blue three ring binders on the credenza in his office on The Grants and myself?

To some of the posters here, to clear up a few of the specious rumors abounding here;

1.) Chief sold Vacuums at Sears in the Methuen Mall. I worked the next dept. over selling kitchens.

2.) He is grandfathered into certification, even though, by his own admission his last annual refresher training was in 1989. And that includes firearms training.

3.) his appointment DID expire on May 1, 1999.

4.) he DOES have TWO personal vehicles at taxpayer expense, the Durango, and the green Mercury.

5.) Although I have never seen it(having never been to his home) I have heard from a number of officers that he has a complete "command center" in his home.

6.) The assertion that days after his heart surgery, he was conducting PD business by phone from his hospital bed is Ludicrous. No doctor is going to allow the stress from work to re-assert itself so quickly after surgery, he is just afraid of losing control.

7.) The selectmen are, for the first time, doing their fiduciary duties, looking out for the town's best interests, in making chief wait until fully recovered.

8.) Did anyone notice we have been down to two top dogs in the PD, and it is still functioning fine, things getting done. And at an annual cost savings of $155,000!

I know that the so-called bloggers here have no agenda other than transparency of local government and to experience peace and quiet contentment in our Town.

Given this, why are the police officers of this town willing (or otherwise obligated) to conform to this nonsense that has divided this town for decades?

Do you really think that when the APD commences an attack on a resident, that we will just stand by and watch? Hardly.

Let it be known that there are oh-so-many residents watching and willing to stand up and say STOP to the oppression, the suppression, the outright dismissal of the wants and needs of those who pay your salaries. There are those outside the town watching and chomping at the bit to displace the tyranny that resides here.

The APD has a very serious problem, the Chief. He had been running 2 departments and several illegal charities for many years until residents did the math and uncovered the errors of his accounting....taking funds that were not approved by the BOS. Hence, he has targeted these residents, and threatened them using his official position in town,. He has been running a glorified taxi service for the town elderly whilst glorifiying himself in this newspaper as a philanthropist and good-deed-doer. The time has come that he be outed publically for the deeds he has done and the families he has harmed.

Mark, tho I may be a fan of yours, I disagree with your statements about the BOS trying to deal with him. They aren't, the yare letting him run wild. He is still running the PD from his bed and all the officers know that if they cross him, down they go when he gets backs.

If he continues to threaten us, we will be there to stand up against him and those who pretend to be in charge. WE are in charge, the people of Atkinson. WE pay the bills and WE get the last say.

Mark. Move back into the realm of sanity. Official Police documents were removed from the station and continue to be removed as Consentino admits repeatedly in the Eagle Tribune.

The BOS is not acting in the best interests of Atkinson or there would be a replacement police chief provided by MRI and in place weeks ago...Mark. Instead we are left with a dysfunctional police department. And you think this is funny and a good thing because it saves $155,000?

What we really need is the fully functional police protection we have ALREADY been overtaxed for.

I would like to commend the chief on the wonderful job he is doing, he has a big heart and gives his job 100% everyday, he puts his job in front of his on personal well being. He has been serving this community and all the people all different ages very well. He is a great man and needs to be recognized for everything that he has done. THANK YOU CHIEF.

Can someone please help me with a small problem that I have. There has been a lot of noise coming from 8 granite ridge rd atkinson nh, it sounds like a lot of "meowing" it keeps me up most of the night, Im not sure if there breeding cats or the homeowner just has a bunch of them, this is not the first time I have called the APD and there not helping, they told me to call animal control, does anyone know how to get in touch with 8 granite ridge rd atkinson nh. I also have seen a tremendous amount of kitty litter being delivered there so im not sure if she has a "cat house home business" might want to contact "conflict of intrest board" see what they say. Any Ideas?

The town can look forward now and discuss the qualifications for a new Chief. That blog post about the polled Chief in Portsmouth caiught my attention.

He, don't remember the name, met with the townspeople three times the same day but different places people go in the town. The town attorney sat with him and they LISTENED to the people's concerns.

It would be great if our new Chief was asked to do it too, like maybe every three months he would take a Saturday, advertise it in the Eagle Tribune and then sit down and answer people's concerns. Like pizza lunch at Atkinson House of Pizza, breakfast meeting at Eggies, how about lemonade outside on the chairs of the Atkinson Country Club or even Brookstone for the Lake People.

The new Chief can get to know the people and issues fast. Meanwhile we get to get to know if he is professional about the job.

In the Application process the BOS could ask a candidate for Police Chief if they are willing to do this. And if they say no, then it could be that shows the candidate has a problem communicating or other antisocial defect.

I would like a new Chief who went after the drug problem in town. A Chief that arrests drunk drivers and drug peddlers in town. I don't know how the selectman can figure out if a new Chief will be tough on drugs or not. But I think this is important. Definitely any officer applying should be drug tested and interviewed by a psychologist. The psychologist could administer intelligence tests as well as psych tests like the Thematic Aperception test. I may may not have spelled that right but the test does and it would be good for the BOS to review all test results before appointing the Police Chief.

Wouldn't it be nice to have a Police Chief who was honest and open with ALL of us. Someoone who fit into the small town environment and was direct and simple. Keep the government small and honest and we will all win. If you cannot trust those around you, this town is too small to hide in.

I think having a college education is very important too. I want someone who I can be proud to have representing me. I think this is entirely possible and I look forward to it. It will happen someday, the sooner the better.

The BOS otta look for a Chief with a degree in economics and fiscally conservative. APD has this monster budget spending and costs need to be cut. A fiscally conservative BOS helps a fiscally conservative police chief with wasteful spending too.

The main thing is that the new Chief have criminal justice degree, but some business background would also be helpful for day to day mgmt of the department.

I agree that we need to start slashing the budgets, looks for all ways to cut expenses. Like turning fdown the heat and A/c, it's always overused in the town hall. This should have happened last season for this fiscal year.

I was wondering about all the PT officers we have, around 17 I think. Does the town supply all the people with guns, badges and uniforms for free and do we get all this equipment back when they are no longer working for us?

I thought of this when reading about someone having a badge becasue he used to be an officier. I would have expected the badge to be taken back.

What is the cost per officer to equip him?

We don't need to expand town hall, if they cleaned it out and reorganized, there is plenty of room.

Secondly, we don't need a new Police Station. There is quite a bit of space in the tv room where they eat lunch. If we get rid of some officers, less space is needed for people.

I will never vote for any more PD space until I see the logs and the existing costs for running the department. You cannot justify a new building or more officers when they claim we have no problems in town.

To July 27, 11:34am; If I remember correctly it costs about $2,700 per officer to equip them. I asked one year on the budget committee, I think that was Billy's response. Gun, holster, body armor, uniform, etc. Plus EVERY officer needs annual training, plus first aid, and firearms training. None of which the chief has had since 1989, according to his own testimony.

We have 5 FT slots and 17 PT slots, If nothing has changed.

I'm not sure where you get your facts Mark and Anon, but as of today, cause I just checked, APD has 4 FT officers and 9 PT officers. If you can show that there are more working cops than that I'll meet you at heavenly and buy you an egg sandwich. Please name all 17 PT cops.

No the PD/Elderly affairs has 11 vehicles to the best of my knowledge, unless they have gotten rid of some. And I did say unless things have changed. When I was on Budget, they had 5 FT slots(yes they are currently down Baldwin) and 17 PT slots. I haven't kept up with the new hires, and losses, so I can not tell you how many are active right now.

I CAN tell you that out of the 17PT slots, only 7 worked with any regularity at the time. The rest worked on average less than 50 hours per yr., and I know the selectmen had discussions about trimming the low hour officers.

Hmmm, hold on;

Full time:
Farrar, Paquette, Van Hirtum, Butler, I think. That would be 4 if correct.

Part time:
Chief, Scarvaglieri, Lam, Jody Consentino, David Consentino, Cammilieri, Ryan, Donnelly, DesJardins, Mullin, Mazza, Buco, Nolan, McCarthy(retired?not sure), O'Meara, Lopez, that would be 16 if still correct.

I just checked with my sources and you are incorrect Mark, Lam hasnt been heard from for 3 yrs, maybe he's been searching for Whitey, Mullin is in Hampstead, Buco is in Sandown, Charlie forced to retire, as was Lopez. The latter 2 never worked a shift anyway. That makes 11. Chief shouldnt be in the equation cause all PDs have Chiefs(some pay 80,000 for FT chiefs we pay 20,000). That makes 10. Jody is a dispatcher (not a cop)and btw all PD's have dispatchers, which makes 9. Dave Consentino has never worked a shift so now we're down to 8.

To be fair you should add one more copper to your list, Teuber (retired Captain from Salem), word on the street a great candidate for the next PT Chief.

11 vehicles for the Elderly Division, plzzz Mark. You are a perfect example of how if you are not questioned you (as is each member of the BOS)can say anything and make people belive it is true. If there are 11 vehicles in the fleet for the MBTA for the elderly if one drives by the PD in the evening there should be 11 elderly vehicles( cars that look like cruisers but aren't), 2 marked cruisers unless the man patroling the streets is at the PD (then there would be 3)2 blue unmarked cruisers, the chiefs car and the vehicle of the officer working. Totaling 17 or 18 vehicles. Bloggers do a drive by tonite and I'm guessing there will be closer to 10 total vehicles in the parking lot.

Are you taking this wager too Mark? Another egg sandwich maybe????

There have been two police vehicles in the Connsetino driveway for years.

I want to know if anyone gave them permission to take taxpayer funded equipment home? The taxpayers did not purchase any vehicles for the personal use of the Police Chief.

7/31 @ 1:33 The Lt. has a lot to lose if he were to not respond. He may not be an officer in Atkinson any longer but he is in neighboring Plaistow. They have a good department and wouldn't want any officer to be of questionable character . It is as though a man in his position of management of the Plaistow police would be asked to respond by the Plaistow chief for the towns assurance that he is of good character. Could it be one of the APD is responsible for the "cat" remarks that are beyond the word wrongful? Wouldn't answering this help Joyce to clear these accusations and her good name? I think if it is a APD person that is doing this he or she can be caught easy enough by getting the address of the computer of where it is coming from. If it is the APD computer then it is curtains for the offending party and surely there will be another law suit in the making.

If your that dumb about why he left to go to Plaistow then you will never understand any known reasons why. If he were to open his mouth and say why then they'd be another vacancy or THREE in the department. Get my meaning now? If that were to happen then he could become the chief or return in his former job as lieutenant. There wasn't a problem for his getting the Plaistow job was there? Sure it did cause a failure of the Plaistow cops to advance and there wasn't any waves about that happening was there.

Salem road rage incident ends in 3 arrests

SALEM — Three men face charges after an alleged road rage incident early yesterday morning.

Police received a 911 call at 1:45 a.m. from the victim, saying he had been assaulted and his vehicle damaged by the trio.

The man was driving in the area of Lawrence and Cluff Roads when the three men in a pickup truck gestured to him, he told police. He thought he knew them and pulled his car over, according to Deputy police Chief Shawn Patten.

The truck pulled over, too, then two of the men jumped out and started attacking the man's car, kicking and pounding on it. They also tried to pull the victim from his car and tried to kick him, he told police. He called 911 and the men jumped back in their truck and took off, Patten said.

The victim was following the suspects while he called 911. The truck pulled over again on Town Farm Road and the victim stopped behind them. One of the men got out of the truck, ripped off his shirt and "charged" at the victim's car, Patten said.

At that point, the victim put his car in reverse and started backing up. That's when police arrived at the scene. The suspect who had ripped off his shirt ran into the woods, Patten said.

But the driver, Dean Bidgood, 21, of Atkinson, was standing outside the truck when police pulled up.

Police determined Bidgood was intoxicated. They also discovered he had taken a dealer plate off the truck and thrown it into the back of the vehicle.

Bidgood was taken into custody and charged with DWI (subsequent offense), criminal mischief, criminal threatening, possession of a controlled drug (Valium), transportation of a controlled drug, misuse of plates and simple assault.

The third suspect, 21-year-old Michael Smith of Salem, was still in the truck. Police discovered Smith had marijuana in his possession. He was taken into custody and faces a charge of possession of a controlled drug. Smith was released on $1,000 personal recognizance.

A Salem K-9 unit arrived and tried to track the third suspect, who had taken off on foot.

At some point, Patten said, that third suspect sent a text message to one of the other suspects, telling them where he was and asking to be picked up.

Police responded to the location in Atkinson the suspect had texted to his friend. With the help of the Atkinson Police Department, police arrested Michael Leavitt, 21, of Atkinson. Leavitt is charged with criminal mischief, simple assault and resisting arrest. He was released on $1,000 cash bail.

When police returned to Town Farm Road, they noticed what appeared to be fresh damage to the pickup. They went back to the scene of the original confrontation and found evidence a vehicle had gone off the road and run over a town sign. Police also found pieces of the suspects' truck on the ground there, Patten said.

Although police said it wasn't entirely clear yesterday, they do not think the victim knew his alleged assailants.

"Unfortunately, in this day and age, road rage is not that unusual," Patten said. "But it doesn't usually escalate to this point."

The victim was not injured, but police said there was visible damage to the trunk and passenger side of his car.

I'm all for those Salem buddies. They seem to run a tight ship over there. They always have lots of interesting things in their police log. Maybe mri will get us a police log with real information about real incidents, name adress, crime. We could be like all the other towns. Now, the only time Atkinson is in the paper is when the Chief wants publicity.

Went by the police station last night to check on the cruisers and count for myself. The Mercury was missing. Ten cars but missing Mercury. Must be what you know who is driving because I heard through the grapevine that Trinity Ambulance was dispatched from the fire station to #140 to remove a dog tongue from a Mercury electric window.
