Moderator Garrity pulls a Polito!

What a Town Meeting we had.

First there was the discussion about the budget. The selectmen were trying to get a new slush fund of $138,000 in a "legal line" for "forthcoming lawsuits", according to Fred Childs. The budget committee arbitrarily cuts this to $80,000 "feeling" that the original request was too much, but not really knowing as all their requests for information went unanswered, as usual. The budget committee, decided they really didn't NEED to know what the money was for anyways, and approved it without ANY DOCUMENTATION to support the request. THANK GOD they are safeguarding our tax investment in the town! I feel safer already!

Then there was the citizen petition warrant articles, which since the passage of HB77 should be going to the ballot WITHOUT ANY CHANGES to the intent or subject matter of the warrant articles. This was mentioned to Moderator Garrity a number of times(he himself being a member of the very legislature that passed this law) he was in a unique position to KNOW the law's provisions. It reads as follows;

"(c) No warrant article shall be amended to eliminate the subject matter of the article. An amendment that changes the dollar amount of an appropriation in a warrant article shall not be deemed to violate this subparagraph." This became effective February 4, 2011.

Immediately after its passage it was the subject of a lawsuit; Bailey v. Town of Exeter. Rockingham Superior Court issued it's decision on May 27,2011. It stated;

"The Court finds that the only way the phrase no warrant article shall be amended to eliminate the subject matter of the warrant article can be logically read is to conclude that any amendment that made the subject matter of the warrant article a nullity was forbidden. Merely because a majority of voters at deliberative session were more clever in how the amendment was worded to create the nullity does not mean that their action was not violative of the new statute."

This came about because Exeter had two warrant articles on their ballot, that, in true Sapia fashion the deliberative session voters changed the intent by inserting the words "to not". Exeter in losing the case also had to pay legal fees. This was also warned to the Moderator, around the same time Mr. Sapia was making a donkey out of himself by doing THAT VERY THING which Exeter lost in Court on. no longer a selectmen but still capable of causing expensive lawsuits! Some things never change.

We also had a number of warrant article submitted by the selectmen to separate elderly affairs from the PD, and move it to the community center. Along with a competing citizen petition warrant article from Phil Consentino demanding that it stay within the PD. But, Phil, I thought we paid you $5,000 to "separate the two depts." after the AG demanded the same? NOW you claim they are still together? WHAT HAPPENED TO OUR MONEY?

But it gets better. In an article for the Eagle Tribune, in which, Phil Stated;

"We got together 110 signatures," he said. "The petition was explained to people, and they came down to the station wanting to sign it. There wasn't any problem getting the signatures."

Thank you, Phil for ADMITTING breaking the law by "ELCETIONEERING". RSA659:44-a states;

"659:44-a Electioneering by Public Employees. – No public employee, as defined in RSA 273-A:1, IX, shall electioneer while in the performance of his or her official duties or use government property, including, but not limited to, telephones, facsimile machines, vehicles, and computers, for electioneering. For the purposes of this section, "electioneer'' means to act in any way specifically designed to influence the vote of a voter on any question or office. Any person who violates this section shall be guilty of a misdemeanor." A misdemeanor, Phil. That is an inauspicious way to end your controversial career.

But it gets WORSE! NOW their are rumors that Phil had his elderly affairs drivers getting people to sign the petitions during their rides provided at taxpayer expense. This would be FAR worse. But, at least Phil has matured in his personal conduct at town meetings, having grown from the spitballs he blew into Carol grant's hair at town meeting a few years ago, to threatening, and harassing Mr. Artus while he waited in line for the mic. Phil was overheard to have said quietly, while standing immediately behind Mr. Artus in line;

"get in your car and go home", "You've lost".

THANK GOD there is no credence to those lawsuits alleging Phil bullied people. And the hits just keep on coming.

IV. Whoever violates the provisions of this section or whoever conspires to violate the provisions of this section shall be guilty of a class B felony.
V. This section is not intended to preclude prosecution or sentencing under any section of RSA 640.

AR2, if you're going to write a story you should really verify your facts. Your assertion that the selectmen were trying to get $138,000 "slush fund" is incorrect. The amount requested of the entire legal line was $128,000. Of that, $28,500 is for Sumner's retainer and $1,500 is for legal filings. This is easily verified if you go to the Town website and look at the 2012 budget which was posted Sunday morning.

The selectmen requested an additional 90K. This was for on going law suits as well as contract work for the PD CBA and the Comcast contract. We carried the legal discussion over a couple of meetings. The selectmen would not tell us what the law suits were for, but did show us bills from the attorneys. Details of our legal line discussions can be found within our minutes. We weren't satisfied with the information received but we did recognize that there were legal bills that needed to be paid so we increased that line 40K. The documentation that you say we did not have was in the form of bills, budget detail, and knowledge of the contracts that had been or needed to be negotiated so your assertions are incorrect.

I would kindly ask AR2, that if you are going to write your own story and publish it as fact, that you at least verify your information.

Nice thing about suing this moderator vs the last? This one is our rep. for Atkinson in the State legislature. Winning will show the corruption goes all the way up the ladder.

Hey Garrity..........if you are sued privately........does your homeowners insurance cover you, or are you going to depend on the extra money in the town’s legal line to protect you? If you invoke you private insurance...is it up to date? How much are you covered for?

Todd, am I mistaken, you seem to be talking about Sumners retainer, whereas the article seems to be talking about the new OPS-legal line that was created at the beginning of 2011.

Which line are we discussing?

Todd, I see the error now. Sumner's retainer is line 41531.320. this is his annual $28,500. Plus he gets another $5,000 or so from the police budget line 42101.320. And his court time comes from line 41532.390.

However the OPS-Legal line 41531.390 was the line specifically added to finish the Artus case after the selectmen refused to apologize to Brownfield to settle the case, and Primex dropped the town. It was initially funded with $10,000, and was overspent by $84.597.00. THIS is the line the selectmen tried to raise to $100,000 citing "forthcoming lawsuits", and that the Budcom knocked back to $80,000 just because $100,000 seemed too much.

The problem is that the Budcom evidently never got the information on this line from the selectmen.

No info on what these "forthcoming cases" are, or WHY they would not be covered by the town's insurance.

AND the fives cases raised at town meeting by Mr. Artus, obtained through RTK, were all zoning issues, 3 of which were closed, two were 1 and 2 years old respectively. This means they WILL NOT BE "FORTHCOMING".

Also, Brownfield and Artus don't need Phil--they are their own worst enemie--and the votes will show it--as it did at the Deliberative Session.

Finally, those that keep suing the town "for our own good" aren't fooling anyone.

Actually Mark, the BoS requested 100K for 41531.390 and we knocked that down to 50K. This is the line with the 10K that Leon believes was added to finish his lawsuit in 2011, but I believe that is incorrect. The 10K was initially added in 2010. The amended 2012 budget that is posted will show that. 80K is the total of all the legal lines, or as you may recall from your budcom days, the unit total.

I know for a fact that the PD CBA was completed in January because I saw the lawyer in Town Hall and I happen to know him. This bill would come out of what AR2 deems as the "slush fund". Similarly the legal fees for the Comcast contract will come from the 50K we allocated for this line. It was our understanding that the last contract cost the Town 35K in legal expenses so 50K seemed like a reasonable number given the lack of information on the law suits.

The bottom line is AR2 is completely off base with the comments about the legal line and budget committee and had AR2 actually done some homework then AR2 would have known that. As it has been said, everyone can have their own opinion, but not their own facts.

Actually Todd;

The OPS-Legal line, the .390 line, was added at the request of the selectmen in January of 2011, prior to town meeting,, to complete the Artus suit, because it was assumed that a NEW insurer would not take on responsibility for the ongoing case.

This line was not used until April of 2011, hence the reason the amount shows up in the 2010 budget, as THAT was the budget in operation when the line was added, but not spent until the 2011 budget, as THAT was the budget in operation at that time. And remember that AT the time this was added, the town's insurance attornies, from the firm of Ransmeier and Spellman had drawn up an agreement to settle the Artus et.al. case, that only required from the town a simple apology for Frank's idiocy at town meeting. It required NO exchange of money. The settlement was signed by the Plaintiffs, and when presented to the selectmen they refused. What followed was an attempt on the selectmen's part to prove a case that had been going on for two years was somehow frivolous., six months later having spent over $90,000 of taxpayer monies in this failed attempt, the case was settled.

THAT is why the line was established. I was present at the meeting at which it was requested.

THAT is my problem with the expansion of that line from the original $10,000(whose purpose no longer exists) to $100,000(selectmen request) or even to the $50,000 that the budget committee cut it back to.

The purpose for which this line was established has ended. When asked WHY the selectmen wanted $100,000 in this line, Fred Childs responded that it was necessary for "forthcoming lawsuits". What the budget committee failed to ask, is WHY any "forthcoming lawsuits" would not be covered under the town's insurance policy rendering this account unnecessary. When questions began to be asked, the selectmen retreated from the previously stated "forthcoming lawsuits" to it being needed for the CBA, and Comcast agreement.

The town spends roughly $10,000 every three years negotiating the CBA for the PD. This is totally unnecessary. What the town needs to negotiate this is not an attorney, but a NEGOTIATOR, who will act with the towns best interests at heart. This has been discussed with the selectmen numerous times, and they usually take the default position of dumping it off on an attorney. The only exception was the 2003 CBA, which was probably the best one for the town's interests.

We have been negotiating cable franchise agreements for 25 years, and have never NEEDED a special line from which to pay for it before, WHY NOW?

I fear the answer is that we don't really NEED it, but that is the only excuse that the selectmen could make that sounded plausible, while stonewalling your request for supporting documentation.

BTW, according to RSA32:16 ANY town official, employee, or agent IS COMPELLED to produce ANY document that the budget committee requests for it's deliberations. The penalty for failure is removal from office upon proper motion for same to the Superior Court.

Your explanation does not make sense to me. In order for the 10K to have made it into the FY10 budget, it would have had to have been added either during the budget process which would occur in 2009 or as an amendment during Deliberative in February of 2010. The only other possibility would be if it was the result of a warrant article that would have added it to the budget.

If he cant figure out the truth as budget chair, how can we expect him to do it as Selectman? At least barbers would be better than Sullivan who is even worse when it comes to being self righteous and arrogant. Or is it a tie, i really can't make up my mind!

But none of the two compare to the idiot former Selectman Sapia who resigned from the Conflict of Interest Committee after "mis-stating" his legal involvement in the Artus lawsuit. Microphone hugger Sapia had to resign after that one.

Can't we find a candidate for Selectman with just a tiny bit of integrity? Is that too much to ask?

There you will find the explanation within the notes section of why this line was added. It was not added in January of 2011 as you stated. If the 2010 budget had been changed in 2011, that would have been illegal. To make it simple for everyone, here's the text from the minutes:

8. The increase is proposed to cover costs of additional legal advice beyond the current town counsels area of expertise. The town’s insurance company handles the law suits within the town, but these funds could be utilized for a second opinion.

I have a question. Where was the AR2 moderator/Mark during the Budget Committee Public Meeting AND Deliberative Session? You could have asked your questions and validated your opinions on at least TWO different occasions before the Budget became FINAL! Where were all the other complainers on this blog for that matter? There were only 50 people at deliberative! If you did not attend then you have no right to complain about the decisions that were made on your behalf. In effect, by not showing up you elected those people to represent your interests.

I have not seen ONE post by Mr. Barbera that was not substantiated by solid facts and/or documentation. To me he represents full transparency, honesty and integrity, something that is desperately needed in this town! I don't see any of the other candidates donating as much time, skill and effort to this town as he does. His success in the upcoming election will be the breath of fresh air we need!

Sorry. I bad starting point is a mistake. Barbara says, Oh the Selectmen might need a third of forth opinion. The town insurance company and there dozens of lawyers, the over paid town attory ARE JUST NOT GOOD ENOUGH. So I, Selectman candidate, will work my busget committee t give the Selectmen $79,000 so they can "consult" Boston attornies to come and milk the Atkinson tit until the $78,000 is all gone. Then they will propose: "Let's just settle and not go to trial like we did in the Artus/Bromfield case". Yeah, the moneys all gone now.

Dec.15, 2009, Thank you for the correction, I remember it happening, but was off by a year.

This line was added to the budget at the request of the selectmen. It was just prior to the town meeting in 2011 that the line was proposed to be used to finish out the Artus suit.

BUT, none of that was really necessary. And that does not explain Fred's original statement that this increase in money was needed for forthcoming lawsuits.

THAT ONE I still don't get. ESPECIALLY since the case numbers the selectmen provided were for zoning issues and cases closed two years ago.

The Brendan Road culvert does indeed run under Brendan Road. It is close to North Broadway and before you get to any of the residences.

I don't go to deliberative session because Phil tracks everyone who votes against him. Everyone knows it. The implication is a denial of police services or harrassment, that we all know he does. He keeps normal people away because it ain't worth it. He's a scary person with a badge. The selectmen allow him to stay in power when he continues to break the law. Another case in point he admits people came to the police station to sign a CITIZEN PETITION. Our selectman are as bad as he is for letting him stay.

As for the post about not going to deliberative session because fear of Phil, c'mon...poor excuse. More likely and believable; the weather was too nice and you didn't feel like going. Don't blame others for your decision to not participate in our town government.

I've seen a number of logorrheic and deceitful things over the years, but Mr. Gary Brownfield's codices really take the cake. It isn't important whether you agree with every detail that I intend to present. What matters is that you begin to realize that Mr. Brownfield is a being who invents nothing, originates nothing, and improves nothing. All he does is commit acts of banditry and insurgency. His circulars are a parody of original thought. Of course, this sounds simple, but in reality, the real issue is simple: By letting Mr. Brownfield reward mediocrity, we are playing a loser's game. All right, I think I've said enough about how Mr. Gary Brownfield's the scourge of all that is good and true. I'd be curious to see if Mr. Brownfield has a persuasive rebuttal.

Billy should put more of his money towards his mortgage payment and less of it to buying votes. Interesting that his fundraising event is being held in Plaistow, rather than somewhere in Atkinson. Wonder how he plans to handle the train layover situation, considering his bosses want it and the residents of Atkinson don't.

Leon Artus might actually be a better choice than Baldwin for Selectman. I think Artus would put the brakes on organized corruption like what we saw at this years Town Deliberative Session. Baldwin is as poor a choice as Paul Sullivan. What we need is a candidate who will stand tall for honest, responsible, clean, town government that benefits everyone, Does this town need more political hacks in love with their own egos, who take advantage of hard working honest people?

Ah yes, brings back memory of Sullivan pointing out Sapia lies about Sumner advice to pick up Blog signs, then going ahead to deny Right To Know information. Guess that was the pay back Sullivan had to give to get back on Sapia's good side.

The last thing we need is to recycle Sullivan to continue his cycle of hate for honest taxpayers. Let's not forget his support for the Conman.

Recycled bad selectmen is equal to forgetting to put the fish guts in the garbage. They both smell bad.

Speaking of Sapia, how many times did he go up to the mic at Town Meeting? He had nothing to add except to imply motive by the names he called them.

He only went up to pontificate and praise people. Why did Garrity allow this? It was as bad as Consentino going up to the mic and no having to state his name and address as other residents were required to do.

As for cadilac Jack going to the mic too many times, I was in attendance for most of the meeting and I belive if it wasnt for Jack Sapia the 2 clowns (Leon and his sidekick) would have continued to make a mockery out of the DS.

Thanks Jack for being Leon's watchdog, whereever he goes I know you are not far behind. I just wish when he was out sucking down a few you were there to notify the authorities. There is a new group
of blue boys in town who I hear love to lock residents up first and ask questions later.

Yes and no; His SALARY in Atkinson was $61k/yr. In Plaistow it is $60K. The difference is that in Plaistow a SALARY is just that, A SALARY.

In Atkinson he also got Training pay, details, and some overtime according to Phil's speeches at meetings. Don't forget the car.

To 2:34pm, Sorry but when he was in the military he DID get paid, every two weeks like clockwork. And his Gross pay was very similar to his Town pay. Remember Phil trying to get him an EXTRA $2,200/mo. from the town, Complaining in the ET that the town was "nickel and diming" billy. Even though he KNEW the town had advanced Billy $5,900 BEFORE he left, so that his family would not suffer.

The town asked for a copy of his leave and earning statement to reconcile accounts. Billy refused to provide it, instead sending a commanders BASE PAY letter which only stated his base pay, omitting almost $2,000.mo.

Billy also has a car to take home, however it got totaled on his way home from work one night, so he's been putting a few miles on the truck. Boo hoo

His salary isn't $60,000, it is $55,000. I'm also factoring the loss of earnings as a part-time officer in Plaistow while he was in Atkinson into the pay cut. Interesting to note that the original Lieutenant position in Plaistow was billed as an evening shift 4pm to midnight position. Ask those guys how many times Billy has worked a full week of 4pm to midnight shifts.

Why not ask him to explain his personal woes on this site and in the papers. Ask him why he went to Plaistow knowing eventually he had the chance of becoming chief? Ask him why his move to Plaistow has caused the many officers there to leave? Ask him if it is fair for him to have caused the problems with in the P.P.D. in regards to promotional opportunities for those who were waiting for the opportunity to advance in their careers? Ask why he demands full military respect for himself in a quasi military police department? I'll bet he refuses to answer any of these questions publicly but these questions are for your reasonable thoughts to ponder when it comes to them and the politics involved. I've been thinking about this. How does he feel about the layover station and what if he opposes the view of his boss, the Plaistow BOS? Will he vote with us and be against it or be for it? If he supported this, I would have to question his motives. This question should be asked of each and everyone of the BOS candidates, it's a real issue in Town.

Also, Bill can't do any business with the Town of Plaistow, like negotiate contracts for anything.

I don't want to have a Selectman who has to be watched every minute, recuse himself half the time. I don't like the idea of him being a former cop and running his old dept. not to mention the Elderly Affairs is still under the same umbrella so he can't vote on those issues either.

Why bother running? What a mess this could become.

The last few comments say it all when it comes to Baldwin becoming or being a selectman. It is better to make do with the ones we have until there is a chance for another change in selectmen seats. Its better to know them from their past experience, good or bad, than some one new that will only continue on as another Conman. His being unable to vote on issues because of obvious conflict of interests would not serve the town and its voters well as the job of selectman requires.

Mr. Baldwin as elected Atkinson rep on the school board has 50% attendance rate per published meeting minutes of school board. His signature was the only one absent from the 2012 school warrant.

Mr. Baldwin did not attend recent Atkinson deliberative session.

Mr. Baldwin did not attend recent TRHS deliberative session as a member of the school board.

Mr. Baldwin sued the town of Atkinson.

Bill I know you're a well intentioned person but you are unrealistic. Have you considered the conflicts with Plaistow and Atkinson issues you'll face?

The position of Selectman requires 10-20 hours a week minimum to be effective. You can't meet school board obligations.

Honestly, what are you thinking? It leads me to question your judgment.

Redact out will be some questions asked by our distinguished town critic, Leon Artus, that are troublesome and caused several candidates to "stumble" and "fumble". Look for the redacted Candidates Night Video to be aired this Sunday night at around midnight. The exact time should remain "undiscoverable" according to Selectman Candidate Barbera, and Selectman Candidate Paul Sullivan asks the show time be "taken under advisement" until after election day to protect the voters. On this issue, Selectman Friel can't be found; Selectman Childs reports his mind is "undiscoverable", as usual.

I hear town moderator Garrity took a dixie from moderating candidates night and Mr. Happy, our truly ignorant town administrator... whats his name? you know,,,,,the guy who never moderated anything in his entire life got the "nod". Well, Mr. Lucky was told exactly what was expected of him and Mr. Happy was groveled to please his handlers once he got his orders. With that humongous extravagant salary I must say he looked humongously ridiculous as Town Moderator Administrator. But then, Garrity got some well earned political protection. That's a good thing. The Good Lord knows, the lawyers wouldn't want to watch Garrity take away citizen rights a 2nd time in one month! Where was Moderator Frank Polito? Couldn't he come to moderate Can Night just once more? Oh, yeah, he resigned because he stumbled and fell over some slippery little RSAs he forgot to learn.

But the good news is....NOW WE GOT....MR. HAPPY as our town moderator!!!!

Personal finances are fair game in an election I will grant you that. Questioning and insulting the honor of a VETERAN OF THE UNITED STATES ARMED FORCES is tastless and uncalled for. He was not dis-honorably discharged and is still enlisted if I am not mistaken. He served in an all volunteer Corp. I am thankful of that and will shake his hand and tell him so.

That's quite a long speech but you still had an amateur moderator with absolutely no experience or the right to shut down questions that truly expose the candidates. I want to see the positive and the negatives these men have to offer. Only a courageous man like the honorable Mr. Artus has the courage, has the guts to expose the secrets these candidates want kept hidden. We witnessed the suppression of free speech in Atkinson by an ignorant and unqualified town administrator who can't tie his own shoe laces? Get real! It is like Frank Polito saying his picture cannot be taken in a public meeting, or State Rep Garrity approving the corruption of warrant articles in Deliberative Session, taking away permanenty, those people's legal right to reach the voters.

This town needs wake-up calls, selectmen candidates exposed for what they are. There is a lot of corruption in this sick little town - nepotism, misuse of town funds and employees, abuse and manipulation of elderly coters and electioneering, violation of peoples rights under the Constitution of the United States of America...and YOU say the candidates should be protected from the tough questioning?

Sullivan got exposed for what he is and called to account is all. As Tony Soprano's mother says, POOR YOU.

I wish my good neighbor, the honorable Mr.Artus's free speech rights were not taken away by that little snot, shut and tough questions allowed to continue for ALL selectmen candidates. Paul Sullivan is the only one of the five running for a selectmen’s position, that has a record to run on. Find it interesting that when challenged about his record, he has to make a deal with the moderator to shut down debate when the questions get to tough.

Interesting that it only took a couple questions for the deal needed to be invoked.

What part of the truth didn't Paul want to get out about him? Was it just part of his record or all of his record?

Paul has a record of not talking about the issues when it strikes to close to him. That night was no exception.
