Maggie's has ANOTHER neighbor arrested!

Apparently Maggies neighbor Mrs. Dubrov was arrested today on a charge of criminal threatening, based on a complaint from Mrs. Osborn.

For those who don't remember, Mrs. Osborn has filed criminal complaints against her neighbor, Mr. Meatey, Mr. Artus, Another complaint against Mr. Meatey, and now Mrs. Dubrov. This is in addition to her ongoing legal issue with Carol Davis for building a driveway across her land. Apparently Mrs. Osborn is not an ideal neighbor to have. Sources in the police dept. have confirmed that this arrest did occur.

The story goes that Mrs. Osborn has been staying in the house at 8 valcat ln. for the last few nights despite a Court Order evicting them from the house. As most of you know, the town has yet to issue the Osborns an occupancy permit for the house, because it has neither a driveway accessible to a fire truck, nor any kind of sprinkler system.

Although Maggie has made numerous promises to put in; a driveway to a class V road with no more than an 8% grade, a sprinkler system, a cistern and pumping system, alternatively to meet fire codes, she has, as usual reneged on all her promises.

It does seem that she has resumed her old tricks of filing criminal complaints against those who stand in her way, and this new complaint seems to be more of the same. It would appear that Mrs. Osborn graduated Summa cum laude from the Phil Consentino school of retribution. Some of you may remember phil's numerous televised attacks on Mr. Acciard, Mr. Kaye, Mrs. Grant, Mrs. Cole, and many, many others. These people go out of their way to make life hell for those who draq attention to their excesses.

The real question here is with Mrs. Osborn's track record of lying to town officials about "owning a deeded right of way" across someone else's land, Filing plan's to build one house then having it redesigned to be much bigger than the original permit allowed, building a driveway across her neighbors land without her permission, and having all of her neighbors arrested on trumped up frivolous charges( none of which have ever stood up in court), why does the police dept. still jump at her beck and call? Still arrest people with no investigation or probable cause other than her word? And why do the selectmen keep turning a blind eye, both to Mrs. Osborn's abuse of her neighbors, and the police depts. abuse of authority. It was bad enough to have the court set the precedent, in the Artus arrest, that the Pd arrests people on no investigation by having the case dismissed because they could not produce basic discovery materials that he was entitled to. That sets a precedent that may undermine any arrest that the PD makes, if the criminal is smart enough to find that case.

Mrs. Osborn, your fifteen minutes of fame is up.

Yes Phil!

Anonymous said...

In stark contrast to this situation are the hundreds of cases where they fail to do anything to stop real criminals.

Anonymous said...

so no probable cause again? this is going to end up in another lawsuit. they can't just go around arresting people without proof of something, anything.

who arrested her?

MAcciard said...

Interesting story, I checked into this this morning, and evidently Maggie claims she overheard the Dubrovs talking to each other on their porch, and she filed the complaint. That gives me a few questions;
1.) The Osborns were evicted from their residence, why is she staying there?
2.) her complaint states that Mrs. Dubrov "purposely..... To Mrs. Osborn" if she overhead a private conversation between two people, she was never purposely threatened, as the law states.
3.) What about expectation of privacy?

I talked to a close friend of mine who is an NYC Detective Sgt. 33rd pct. He said that his dept. never would have arrested on a complaint alone. They would have investigated, interviewed any witnesses, and if there were none, told the complainant that she was not directly threatened, and there was nothing they could do, other than to talk to the perp, and explain that they should watch what they say. This sounds fishy.

Anonymous said...

It does sound fishy. They should investigate this for a possible false claim to the police.

Anonymous said...

WOW, This is the same thing she did to her neighbors down on hemlock heights when they complained about her driveway across the town beach area. same shit different day same spineless selectmen.

Anonymous said...

ok she claims she overheard a conversation between two people on their own property, while she was violating a court eviction order, and she has a documented history of lying, and the Police arrest the neighbors? HUH?

scoobydoo said...

Just to clarify, the hemlock heights beach is privately owned (by the DEEDED members of the hemlock heights improvement association).

Anonymous said...

It's obvious where the real problem is.

Anonymous said...

Not that obvious if our DUMB police Dept can't see it! No HONEST taxpayer is SAFE from them.

That's what we get for having an unqualified police chief with a BLOATED BUDGET in charge.

Anonymous said...

I cannot believe that this stuff is going on!

You cannot just go arrest a person without just cause and evidence. It doesn't sound like they have either one.

We do not need any more lawsuits in this town.

Anonymous said...

Can you imagine calling the police every time you overheard someone saying something you didn't like?

Wow. Then they get arrested? This doesn't sound like a credible threat to me nor does it sound like a rational way to deal with this complaint.

Anonymous said...

Mrs. Dubrov should call the State and file a formal complaint against the town.

Anonymous said...

Sorry but they shouldn't have pissed off one of the chief's biggest donors! Thats what happens

MAcciard said...

I have seen this movie 3 times now. So evidently it is the policy of the Atkinson PD to arrest and criminally charge someone solely upon the complaint of someone else, prosecute them with zeal, and when the case falls apart, the complainant walks away with no ramifications.

So I guess, based upon these actions, if I filed a complaint that the chief of police threatened me, they would rush right over to his home and arrest him, charge him, and prosecute this all the way through to trial based solely upon my word, right?

But, no they do not do that, because when he DID threaten me, and I DID complain about it, his bosses the selectmen did nothing.

Guess it must depend upon who you are. So much for "Equal treatment under the law".

Anonymous said...

If you are considered an enemy of the STATE of Atkinson, the Atkinson Mafia will be sent to your door in the person of a jack booted police officer. He may appear to be a pipsqueak but his boss is a bullyCON.

Anonymous said...

That's funny, I didn't know that the Osborns weren't legal residents of Atkinson. I see her every morning taking her kids to the Atkinson Academy. We drop off at about the same time. If they aren't residents, why are their kids in our schools? Do they pay tuition?

Anonymous said...

The better question is; if the court has ordered them evicted, why are they still living there, and why arent the selectmen doing anything about it?

Anonymous said...

Why is the PD reacting to her as if she were a resident, taking her complaint, responding to her house? What address is listed for her on the police report? Isn't she is an illegal alien?

Does anyone have copies of the police report to post here?

Anonymous said...

ISn't this tax evasion and fraud?

Anonymous said...

Mark, I have to disagree. I filed a legitmate complaint and the police refused to do anything.

The criminal was caught red handed and the police refused to file charges against him.

Anonymous said...

was the perp a FOP(friend of Phil's)?

Anonymous said...

well I don't know.

Anonymous said...

It was one thing when we were all laughing about the antics in this small goofy town, but now people are getting hurt by the dirty politics.

Anonymous said...

The TA has the experience to be advising the selectmen and the police department. He should be utilized in this way. Also, since he has this experience, the town can never say they didn't know any better.

Anonymous said...

In my mind, this ranks up there with the time Mrs. Grant was thrown out of town hall before she could put her son's coat on in the winter.

If there are honest officers who could come forward and finger the responsible party, the time is long past.

Anonymous said...

Get real. Police officers aren't going to turn Consentino in! They don't want to lose their jobs. Their "Code of Ethics?" won't allow them to do it either. Phil "Gambino" CON-sentino would CRUSH them.

Dobrov's arrest is just another "remake" of arrests that Consentino has orchestrated in the past. No honest citizen is safe while he remains in office.

Anonymous said...

Get real?

Someone has to stand up for the residents. ALL officers take an oath to serve and protect and there is no clause that allows you to violate the oath if it means that your paycheck is on the line!!!

I DO SOLEMNLY DECLARE UPON MY HONOUR AND CONSCIENCE THAT I WILL ACT AT ALL TIMES TO THE BEST OF MY ABILITY AND KNOWLEDGE IN A MANNER BEFITTING A POLICE OFFICER

I WILL PRESERVE THE DIGNITY AND WILL RESPECT THE RIGHTS OF ALL INDIVIDUALS

I WILL DISCHARGE MY DUTIES WITH INTEGRITY AND WILL PROMOTE UNDERSTANDING AND CONCILIATION

I WILL EXERCISE MY AUTHORITY AS A POLICE OFFICER IN THE MANNER INTENDED BY THE LAW

I WILL FAITHFULLY OBEY THE ORDERS OF MY SUPERIORS AND WILL BE READY TO CONFRONT DANGER IN THE LINE OF DUTY

I WILL ACT WITH HONESTY, COURTESY AND REGARD FOR THE WELFARE OF OTHERS, AND WILL ENDEAVOUR TO DEVELOP THE ESPRIT DE CORPS

I WILL ACT JUSTLY AND IMPARTIALLY AND WITH PROPRIETY TOWARDS MY FELLOW OFFICERS

I WILL CONSTANTLY STRIVE TO HONOUR THIS OATH IN MY SERVICE AS A POLICE OFFICER

Mark, your always crying foul. Where are your investigative skills. You use every opportunity to attack the selectmen and the police department. Where are your facts. Maybe the Dubrovs are doing something illegal. Did you get a copy of the report?

Spin, Spin, Spin... Shame on you for miss leading others with your blog. Give us the facts Mr. Investigative Blog Reporter.

Spin, Spin, Spin... Shame on you for miss leading others with your blog. Give us the facts Mr. Investigative Blog Reporter.

To the last comment;

Actually I believe you are wrong, I have tried to maintain a low profile in town, deciding after the vandalism that it is just not worth it, Phil won. however I have not given the selectmen enough grief, because the very things it is their duty to supervise are still happening, and they are still doing nothing.

And yes I have seen the complaint. IMHO there is no way the state can prove criminal threatening. Maggie apparently "overheard" a conversation happening between husband and wife in their own home, assumed it applied to her, and claimed to have felt threatened. Similar to her claim to have almost been run over, or her claim that Mr. artus blocked her from getting her kids to school, or her claim to have seen her neighbor walking on her property with a weapon. She must have an overactive imagination.

According to RSA631:4d, Criminal Threatening, which is what the citation is for, states;

A person is guilty of criminal threatening when:
(d) The person threatens to commit any crime against the person of another with a purpose to terrorize any person;
(b) As used in this section, ""terrorize'' means to cause alarm, fright, or dread; the state of mind induced by the apprehension of hurt from some hostile or threatening event or manifestation.

In order for this to stick there had to be intent. Purpose, the complaint says that Mrs. Dubrov, "purposely threatened murder on Mrs. Osborn". If Mrs. Osborn was eavesdropping on her side of the fence, how could the Dubrovs know?

Plus the general lack of evidence, and investigation characteristic of arrests at Maggie's behest.

BTW, it is not "my blog". Phil and his attornies spent thousands of dollars trying to prove it was mine, only to fail miserably, I merely post here, just like you.

The problem with your oath is:

I WILL FAITHFULLY OBEY THE ORDERS OF MY SUPERIORS..........(even though I know he is wrong)

You superior IS your problem. You all know that Maggie has used the Atkinson Police Dept. to file false reports against honest taxpayers and has lied repeatedly to the selectmen. You as police officers are ordered to arrest those honest citizens so your untrained chief(?)can exact retribution against them while supporting the Osborns.

Taxpayers don't blame you for not standing up to him, because it will cost you your job AND you will be BLACKBALLED from EVER serving as a police officer again. (because you would have violated your UNWRITTEN OATH NOT to RAT one another out.)

The good officers that have had this happen to them have gone before you. They have experienced your chief's wrath. You have learned YOUR LESSON. No one expects you to keep your oath, your families depend on you. That's why I told the previous poster to get real. The best you guys can do is take orders. Stop posturing and get real. You are the chief’s puppet and there is nothing you can do about it. Taxpayers know the truth all you have to do is admit they are right. You will feel better about it.

Puppets or not, I fully expect them to uphold the oath and I don't really care about their paycheck.

Do this this amounts to being bought. When a person shuts up and does wrong or looks the other way as to not get involved and fails to stand up for what is lawful, they are violating their oath of office. This goes for elected and appointed officials and police officers alike.

Anonymous said...

I just read the paperwork too and I agree with Mark.

This won't hold up and is just an attempt by the desperate to use their influence to attack their good neighbors.

GAMBINO'S PUPPETS!

Now there is a PATCH that should be stitched on every Atkinson police officer's uniform!

Anyone see the new business opportunity as a "Start Up" company to spur our economy?

Anonymous said...

Better still:

GAMBINO'S PUPPETS!

Tattooed on every selectman’s forehead for us to see at every Monday night's selectmen's meeting.

That would show their support for CON-sentino’s arrest of innocent taxpayers!!!

You don't have to wait for the Taxpayer's Association TO GIVE YOU what you want. Go to the CON-sentino police station and request it under the RTK law and see what he doesn't give you. Post back and tell us if HE gave you anything.

Status Quo ya know!

Take your checkbook and be sure you have PLENTY OF MONEY in your account.

YOUR GAMBINO SELECTMEN have a NEW GAMBINO POLICY to make you PAY BIG, so they can protect the "GAMBINO GOD FATHER"!

GAMBINO ARREST OF INNOCENT PEOPLE, GAMBINO PAYMENTS FOR REFUSED RTK INFORMATION, GAMBINO SELECTMEN WHO USE THEIR AUTHORITY TO PROTECT THE OSBORNS ILLEGAL TAKING OF OUR PROPERTY AND POLICE CHIEF, GAMBINO PAYMENTS OF YOUR MONEY TO PAY FOR THE INCREASED LIABILITY INSURANCE PREMIUMS FOR THEIR FAILED LAWSUITS. HOW MUCH PROOF DO YOU NEED THAT THE GAMBINO FAMILY IS RUNNING THIS TOWN?

PS. Wouldn't you really like to know how many of these people are a MEMBER of the LION'S CLUB?

Dubrov is INOCENT AS CHARGED, CON-sention and our selectmen are responsible for an illegal arrest.

HOW MANY INNOCENT PEOPLE ARE YOU GOING TO ALLOW BE CHARGED MR. CHAIRMAN BEFORE YOU PUT A STOP TO IT? HOW MANY INNOCENT PEOPLE MUST YOU SACRIFICE BEFORE YOU REALIZE THE ERROR OF YOUR WAYS? HOW LONG ARE YOU GOING TO BE LEAD AROUND BY THE NOSE BY CON-SENTINO? HOW MANY TIMES MR. CHAIRMAN...........HOW MANY TIMES?

The police are there to protect and serve. They wouldn't do anything wrong would they?

Most officer of Atkinson have a lot of training. Also Atkinson has had a couple of criminal threatening case in the past weeks so the cops know what they are doing. I think maybe this how it happened

Buford T. Justice: I saw that, you sombitch! You did that on purpose! You're going away till you're gray! I got the evidence!

Buford T. Justice: Put the evidence in the car.

Junior: But Daddy...

Buford T. Justice: Put the *evidence* in the *car*!

Buford T. Justice: I'm gonna barbeque yo' ass in molasses!

well, get the report! let's see it.

So Mrs. Dubrov threatened "Murder"... Who does that? And Mark you think thats ok? Why are you getting so involved? Because the police answered a complaint of Murder, over heard or not, "WHO DOES THAT"?

Do you know anything about the Dubrovs and their history?

Get the facts before you call foul, know who your defending.

Anonymous said...

All of us at some time or another have said, 'Oh, I could kill him'. That is not a direct threat to anyone unless it made made TO the person. It doesn't count if one is hiding in the bushes eavesdropping on the neighbors private conversion in their own home, especially if they do not name the one a$$ they wish to murder.

Why don't they have her arrested for stalking or peeping?

Anonymous said...

Why didn't Menino get arrested for his remarks?

Because everyone knows it was not a real threat.

"If I saw these guys in a dark alley, I’d like to have a fight with them,’’ Menino said “I’d do some things that would be worse than the death penalty. Because it wouldn’t happen in a second. I would slowly torture them.’’

Anonymous said...

This is not about the history. History doesn't come into play here. She was arrested for being less than tactful and everyone should be shocked by this.

Who's next? If you are in with the right people, can anyone accuse you of something and have you arrested for it?

Anonymous said...

The bottom line, our PD can't run things professionally and the the Artus case is perfect example where no evidence was provided (DUH!). It will cost the taxpayers again and again and again but they keep the PD taxi service for seniors going on our tax dollars and that gets votes which keep people in power. What a scam. If you don't inform your friends and neighbors of the truth and don't get them out to vote the status quo will never change.

Anonymous said...

This also shows that you cannot get any EA or PD services unless you are on the list of supporters.

MAcciard said...

Wow, 11:18;

A little hot under the collar aren't you? First, I never said I think threatening murder is ok, but from reading the report, I don't see any threat. Second, I am not defending anyone, nor am I "getting so involved" with this, this is commentary. A Threat requires intent to intimidate, I don't see that in the report. And knowing what I do about Maggie's previous complaints, I can not just take her word for anything. I mean, come on, this is a woman who effectively stole someone else's land for their own use, is this someone you trust? Third, according to the report, no names were mentioned, why would you assume that you are "the bitch", if what is reported is true? Guilty conscience?

Anonymous said...

That's one for Macciard and now for round two! The question is why wont the selectmen do their job regarding the towns best interests? That being that they do some thing about this ongoing baloney rather than having the town face law suits that most of all seems to be on a bimonthly basis.

Anonymous said...

How can anyone expect things to get better with the BOS when the same rogues that organized and rule the roost are still there.

Mainly, because they are not there to help the Town but for following orders.

How can so many people get caught up in this and not have one of them call foul? It is so obviously
deceitful and illegal to carry on as though you are doing what you were elected to do.

The old adage of "You can't fight City Hall" is still true I'm sorry to say. It takes integrity and I'm afraid that has gone the way of "whatever"

Anonymous said...

You can upset the apple cart in the next town election simply by making the choices you want to make . When you go to the ballot box to turn in your vote do not be intimidated the person "helping " you to put the ballot through. Just be sure its turned up side down from your selected vote for selectmen, etc. so the assistant can't tell anyone who you voted for. Its the true American way in the electoral process.

Can we just have the Plaistow Police take over the day to day operations? Since we don't have a real 24/7 force anyway it may be a way to save our taxpayers some money and a lot of grief. I am tired of the antics and the legal fees.

Anonymous said...

The issue of whether or not the Plaistow Police could or could not take over the police department is a moot point.

The Plaistow Police Department runs two to three cars a shift for their entire town. What do you think the response level would be for the residents of this town if the two to three PPD cars a shift are off protecting the Town of Plaistow? The answer is that the Atkinso residents would be at the very bottom of the list.

For all the complaining in this Town, even Mark Accaird has to admit that the Atkinson Police has good, well trained professionsl police officers that even has had positive direct contact with. Officers like Vanhirtum, Paquette, Donnelly, Farrar, and Nolan.

Not one person in this Town can complain about the response level from the police in this town to even the most mundane call. You make a call about a "suspicious" vehicle or person in your neighborhood, then the APD is there within minutes.

How many residents can complain about getting written tickets? The answer is none. It is basically an unwritten rule that the officers are told to give residents the benefit of the doubt and issue them warnings. Do you think that happens in Plaistow? Do you think that happens in any other town?

You want to use the PPD to patrol Atkinson? Fine. be prepared to pay twice as must for that coverage. Why? Because Plaistow is not going to do it with the officers they already have. They will absorb the full time officers already employed by the Atkinson Police. So YOU the tax payer will still be paying for the salary and benefits of police officers.

How about the police station? Thats going to be kept open. Why? Because it will be considered a substation and the officers assigned to the Atkinson Precinct, will patrol out of it. Why? Becasue using PPD's station would mean that response times to calls off of Route 111 would take up to 15 - 20 minutes or longer. If you live up there, would you be happy with wating that long or longer for a cop to show up and take your report? No.

The vehicles? They are going to stay too. Why? PPD is not going to beat their existing fleet into the ground. So you the taxpayer are going to pay for all the cruisers to be repainted and outfitted, etc. The same goes for uniforms, patches, and even weapons. The APD and PPD carry different pistols.

To say that there isnt a 24 / 7 police force is false. It is a lie. There is always an Atkinson Police Officer on duty 24/7/365. Five days a week, for 3 eight hour shifts a day, those shifts are worked by the full time officers. The remainder are worked by the part time officers. And the part time officers that work the road are not the Chief's cronies or officers you may remember from "back in the day". They are professional and they all do their jobs.

You want to rail against the Chief and Baldwin? Go ahead. But show some respect for the rank in file. Think about how hard it is for them to do their jobs in this politically charged environment. They get it from both ends. One is management and the other is the people.

Last, to Mark Acciard, if you saw the paperwork...what was the case number so I cam request a copy of the report? I would love to see it.

Sorry for the length of the post. Had to get this off of my chest. This blog does nothing but post one side of a story and does no investigation of its own...can we hear the other side? The blog seems to know all the facts...why not post them...why not post a copy of the police report, the complaint, and the warrant and affidavit? Let the people read and decide for themselves. All that information is public record. Go to the court and request it. Stop relying on Team Blog to tell you what to think and who to hate.

To the officers of the APD. Keep up the good work. Show up work everyday and answer all your radio calls. Stay safe and come home too your families at the end of all your shifts. God Bless!

I disagree with most of the previous repeated propaganda.

Anonymous said...

I agree. It's just the Chief pretending we can't get along without him and HIS form of police protection. Everything he says in his posting proves we should disband his dept. and move it to Plaistow. At least they have a REAL QUALIFIED POLICE CHIEF to deal with. Perhaps their chief will stop arresting innocent people to protect one of his donors.

All of our officers will still have jobs working for a real police dept, and our unqualified chief will be retired. That's a WIN WIN for EVERYONE.

Since when did the Plaistow Police Department become this elite law enforcement agency in the state?

The points that the longwinded poster was trying to make can be summed up:

1. The problem is the Chief and the BoS who do nothing to reign him in and stop the shennanigans.
2. Contracting out to Plaistow is going to cost the Atkinson taxpayer more in the long run.
3. The Atkinson taxpayer is still going to be responsible for the salary, benefits, and other costs included with operating a police dept.
4. Plaistow is not going to police Atkinson with the officers they currently have. The poster is correct in saying that they (PPD) only have 2 to 3 cars per shift; and the number is closer to 2 guys on per shift. So the full time officers from Atkinson are going to get absorbed into the new crime fighting force known as the Plaistow / Atkinson Regional Police Department.
5. The building and vehicles are going to get folded into the deal; and we are still responsible for those. Does anyone think that Chief Savage is going to pass up a half dozen or more police vehicles?
6. The Atkinson PD is 24 /7. An officer is always on patrol and not just home on call. As a matter of fact, the PD is the only town department that is fully staffed and operational 24 hours a day.

Why dont we fix the problems we have in Town instead of looking for a quick fix and a "grass is always greener" solution?

If Savage gets CON-sentino's blotted budget to work with, Atkinson would be well represented with REAL 24-7 service. Throw in our cars, GOOD officers and equipment, I bet he would pay for the patch changes and car decals out of his own pocket. He would be in seventh heaven.

That long winded posting is a CON-job from our long winded CON-sentino attempting to protect his own turf. CON-sentino would be the first Savage would fire in the change over. (Selectmen would have to do nothing as usual) and the Town (s) would be better off with the change.

A WIN WIN for both Town(s)

Anonymous said...

Things like this take years to negotiate. They don't happen overnight. IF it were to happen, it would have to be planed for so there wouldn't be a time where there was no coverage or patrols.

Let me ask you this, has anyone even asked Plaistow if they would want this?

The simple fix would be to have a regime change and start over with the remaining full time officers and the few part time officers who would stay after Consentino left. We'd wind up with a much smaller and more efficient department with a more manageable budget. Drastic changes with no fore thought never end well.

Anonymous said...

Plaistow Police Department is not the elite law enforcement agency in the state, but compare it to Atkinson and it would be!

Savage is a trained and qualified Police Chief, CON-sentino isn't qualified to polish Savage's shoes.

CON-sentino isn't qualified to fire a gun, and Savage would be hiding behind a steel door if CON-sentino tried.

Hell, EVERYBODY would be running for cover if the CON MAN even tried to fire his weapon! :)

Anonymous said...

They may be fully staffed 27/7 but they are far from operational.

If there was a management change, why not change them all out? They are ALL enabling this farce to continue.

Ever call them? 'Sorry Sir, we can't do anything 'cause we saw nuttin'. 'Aw, we can't arrest the perp, Chiefo won't let us'. 'Can't help you, I'm here to just collect my check and wait fo my retirement'.

I doubt anyone has talked to Plaistow YET. Why not do both? Talk to Plaistow and start planning the regime change now?

We could have a PLAN A and PLAN B. When PLAN B fails because our selectmen won't make a decision, PLAN A will kick in and we will get to dissolve our FAILED ATKINSON police dept.

As you have probably read from my posts in the past, my personal experience with our PD is that most of the rank and file officers, are trained, have a sense of professionalism, and try to simply do their jobs. They are hampered by an ineffective, uneducated, untrained, and un-appointed chief of police, who is has no problem using the power and authority of his dept. and badge to waste the taxpayers time and money investigating his critics. He has done this time and again, with inpunity from the selectmen.

MAcciard said...

Was it you, who scratched that into every body panel of my car, while it sat in my driveway, just because I had the temerity to sue to get the police chief to stop calling my customers and suppliers, telling them i was "under investigation" by the Atkinson PD, after the selectmen, of which he was one refused to act?

You don't HAVE to give the police chief REASON to harrass you, all you have to do is question his actions.

All you have to do id file an ethics complaint when he refuses to stop voting as a selectman, on his own requests as police chief.

This alone gets you tickets for unattended vehicle.

This alone gets you lied about, by the chief on camera at selectmen's meetings.

This alone gets you followed through town by the chief, and your wife too!

This alone gets you gets you verbally threatened by the chief at the post office.

This alone gets you and your company investigated by the police chief, not for anything YOU did wrong, but because he wants to FIND something to use against you.

This alone gets you to have to suffer your past clients being called by him, in his "investigation".

This alone gets your car and your house vandalized with the very words you just used!

Think about it, this is all amply documented.

MAcciard said...

I apologize for the tone of my response to you. Generally this blog discusses issues in town. Yes, it is usually critical of our police dept. but to be fair, there is a lot of grist there.

The problem, as I have stated before is not our rank and file officers, it is the untrained bully with a badge that heads up the dept.

Even my dealings with Lt. Baldwin have been professional, and he has largely acted correctly, with the exception of his dismal performance, screaming at all of us at deliberative session 30 months ago. My only issues with the Lt., as I have stated both here and to him in person, is his frivolous lawsuit against the town to try and obtain appt. as Lt., the lying, obfuscation, and threatened lawsuit over military pay differential when he was deployed in 2003-2004, and a couple of other smaller issues.

Do not judge the relative value of this blog, by one debate, The problems with the PD leadership are legion, and until you are aware or have witnessed them yourself, you could have no frame of reference to even find these incidents believable.

To 1:32am;

Please go to the town website and take a look at the selectmen's meeting minutes from May 19, 2003, and June 9, 2003.

Here is the story;

Then Sgt. Baldwin was deployed to active duty in Boston, later to be shipped to California then the Persian Gulf.

Selectman Boyle offered to pay him and advance of $5,900.00 so that his family would not suffer any hardship from a difference between his town pay and his military pay. They asked for a copy of his military Leave and Earnings Statement to verify the difference, for those who never served this is the equivalent of your paycheck stub, it has all your earnings on it.

Baldwin refused to provide the LES, instead giving the BOS a letter from his commander stating what his base pay was. Again, for those who don't know, base pay is usually roughly half of what you earn, particularly when deployed.

The chief argued vehemently on his behalf for a difference of $511.51/wk.! over $2,000.00 per month! Claiming the town was nickle and dimeing the Sgt. In reality the difference in pay was about $450.00/mo. and the $5,900.00 that the town had advanced him amounted to approximately 15 months compensation. This drama ended with the Board taking a formal vote to demand that Sgt. Baldwin return the $5,900.00 which to the best of my knowledge he STILL has not done.

My problem with this is the lack of honesty. He and the chief were trying to get him almost $2,100.00/mo. when the actual loss he was suffering was only $450.00.

This was while Baldwins lawsuit was going on against the town. He claimed that the town had promised him the Lt. position( a position which did not exist mind you, the town had never had a full time Lt., the Consentino, Sapia, Childs Board created that position for the first time without putting it before the voters) He also claimed that the town had not reimbursed him for college courses taken. Neither of his claims were true. The town had agreed to CONSIDER him for the Lt. job, if and when they decided to create one, and the town had the cancelled checks from his re-imbursement.

I hope this explains my prior statement for you.

BTW, the Baldwin lawsuit pleading is up on the Atkinson Taxpayers website.

Anonymous said...

Thanks Mark. This is just another example of the corruption that goes on in this town, sponsored by CON-sentino with the help of the selectmen. Your tax dollars are used to support the corruption and you won't do anything about it.

MAcciard said...

To 11:27am;

I have made no secret of the fact that I have little respect for the chief, that is simply what he has earned. As to his lawsuit; I filed a code of ethics complaint against the chief for paying himself a $1,300.00 "union benefit" to which he was not entitled. He put that authorization in as police chief, and signed it authorizing payment as a selectman. That was wrong on so many levels, not the least of which is that the first paragraph of the union contract forbids the chief from participating in the contract, because he is the chief.

At the code of ethics hearing on Jan. 20, 2006, when COE Chairman Dick Smith told me that "we only listen to legal opinions that confirm the way we are already leaning" The chief claimed that he had been receiving "that benefit for 4 years, since before he was a selectman". That was a lie! Mr. Smith asked him 3 times; "So you have been getting this since 2002?", " you have been getting this before you were a selectman?".

Chief lied again by answering yes. Mr. SMith then asked me if "in light of this new evidence, will you withdraw your complaint?". I replied to give me a day to check it out, and that if what the chief said was true, I would withdraw it and apologize publicly to him.

i checked with the town bookkeeper and found that the only time he had received that benefit was the time I complained about! It wasn't even a benefit until after town meeting of 2003 when the voters approved the new contract, and the first time it became eligible to be paid was on Dec. 2003, The time that I was complaining about.

I then wrote a letter to Mr. Smith, detailing what I had found out, including the documentation, stating that they were now faced with the town's chief law enforcement officer, and a sitting selectman who had lied to their duly constituted board of inquiry, for the purpose of getting a complaint against himself dismissed. A clear pecuniary interest, what were they going to do about it.

The chief filed his suit with only one cause of action, that i stated that he lied. He did!

At the scheduling conference, his attorney, Mark Giarrusso, approached me and offered to withdraw his case if I agreed to pay the chief $15,000.00

I told Mr. Giarrusso that if his client paid me $15,000.00 i would refrain from airing his dirty laundry in open court.

The chief, after a year of slandering me at selectmen's meetings, withdrew his case two weeks before trial. I tried to object to the non-suit, but was unsuccessful.

That is the true and accurate story of the chiefs attempt at intimidation through the legal system.

To 10:58am,

Sorry I missed yours,

So if that position existed previously please tell me who was the Town's full time police Lt. before Baldwin? And if the position was vacant for more than 180 days why they could violate town policy, and not put it before the voters?

Fact is we NEVER had a full time Lt. before him. The BOS can not legally create an employee position, the voters can. The last Lt. before Baldwin was Rick Daniels, who left over a falling out with the chief in 1991. Then we had Capt. Yatsevich for 18 months in 1998-1999, he left claiming that the chief would not allow him to do his job. Daniels was PT. Yatsevich was FT. Capt. position vacant for 8 years! It no longer existed. And Baldwin is not a Capt., hence new position.

Oh Mark.

Can't you run the town and the PD for us?

That was a serious comment BTW.

So I guess we got the Lt. the same way we got the Expedition for the police dept., right?

Anonymous said...

right!

MAcciard said...

No not quite, Actually the SUV purchase was probably illegal. Town meeting 2005, nothing was said about buying an SUV for the PD. Yet 8 days later, the chief of police lease purchased a $30,000 SUV for the PD.

The selectmen did not vote to purchase the SUV.

The selectmen did not vote to give Russ authority to sign the lease committing the taxpayers to the expense.

The selectmen did not vote to overspend the vehicle lease agreements line item, or to move money out of another line item to cover the overexpenditure.

Selectman Childs admitted in a Budget Committee public hearing that the board did not know he was going to buy it till it was already here. He said it was the budget committee's fault for giving him $3,000.00 extra in his budget that he used to purchase it. But Both selectmen Childs and Sapia, blithely signed the voucher to pay for it, without asking any questions.

If the Budcom hadn't noticed the over expended line item in the quarterly reports nobody would have been the wiser.

What a town I live in! The venomous bile that's written on this blog about the Osborn family is truly despicable. Rather than read the police report and perhaps learning both sides of the story, the heroic anonymous bloggers spew opinion and conjecture at this story as if they actually knew anything. I've lived here for years, and for the life of me I've grown to wonder why. You're attacking this family - lovely people if you actually talk to them sometime - as if they're the worst dregs of society. Shame on all of you for your horrific behavior. Having a blog, a small band of loud lawsuit happy misfit friends and a speed-dial hotline to the Eagle Tribune does not make you right, either factually or morally.

Want to use your venom productively? Continue to attack the schools for poor performance. Maybe run for office and try to change something instead of whining about it constantly. Maybe travel outside of the town once in a while and learn that there's more to life than scaring young children just because you don't like something their parents did.

Anonymous said...

Well said, I agree.

Anonymous said...

Get over yourself.

Read the documentation and stop spreading your ignorance here. Your comments are truly insulting and these 'lovely people'have been attacking their neighbors and costing them money and time.

There are people here who volunteer and try to make the town a better place, don't destroy neighbors property and turn the other cheek.

How dare you say these things?

Anonymous said...

I always love the ones who yell at the bloggers for yelling at the bullies.

Ok for them, not ok for us.

Give me a break.

Anonymous said...

Spreading my ignorance??? Wow, what a foolish statement. Look in the mirror and try - TRY - to see past your blind hatred for these people and maybe understand a little more about yourself. Frankly I don't see you doing it. I noticed that as soon as you heard an opinion that was contrary to yours you attacked me with your toxic nonsense. What does that say about you? It tells me that you don't want an open dialogue on this blog, only for people to hold up your views as the mighty truth. Does that insult you?? I apologize for having the audacity to say that perhaps there's more than one point of view on this topic.

As for loving the ones who yell at the bloggers for yelling at the bullies, I think you've lost perspective on who the bullies are. All you've done is reinforced what I thought all along: Those who spend their days gleefully putting down others are too small to comprehend that they might not always be right.

Sorry to spoil your bash party with a dose of reality.

Anonymous said...

Wow, the blog finally got interesting. So glad to see another point of view for a change. At least Acciard uses his own identity to attack the Osborns. It gets really boring reading all the anonymous people attacking their neighbors. So much unchecked hatred gets old.

Anonymous said...

Write a long post, wait an hour, post again saying what a good job you did.

Typical day at the Town office.

Pretend, pretend pretend.

Anonymous said...

Sure, pretend, pretend, pretend. Aren't you cleverly dismissive? Box up all of us and call us the same three people to justify what you believe you're doing is right. Wrong on all counts. Maybe you should wait an hour and write something else idiotic? I'm driving to work myself, which thankfully takes me out of this town for a reality break.

Okay, that gives you at least 8 hours to write something clever again. Are you up for the task?

Anonymous said...

I don't know any of the parties up at the lake.

I do know that no one should be taking the property of their neighbor and plowing a road thru it. When this started last year, I could not believe this was really happening so I read the docs (both sides and the deed) and drove up there to see for myself. Much has changed since then and I am shocked that this is happening. I am more shocked that anyone is defending the Osborn's. If they wanted to change the right of way, there's a right way and a wrong way to do it. This is appalling.

As to having a neighbor arrested for threatening? We shall see if this is not just another he said - she said, unprovable case. How many people are they going to have arrested up there over this?

I also think the police made a mistake not to give discovery to Mr. Artis, it's the law so why would they not, unless they had none?

The only ones who are venomous are those who are causing problems for others and attacking here since they have no real case.

One of the Atkinson police was a fighting with a man in the Market Basket in Plaistow the other day.

Anyone else see this? What happened?

MAcciard said...

to 3:04pm;

What are you talking about?

The police report is on the Atkinson Taxpayers website, anyone can read it. As for the other FACTS, not evaluations, of the Osborn's actions, those are readily documented in meeting minutes, at town hall, on the internet, and in Court records. Facts are Facts. They laid a driveway across a neighbors land. That is a fact. They had no legal right to do it, That is a fact. They began by claiming to "own" a deeded ROW. They have withdrawn to now claiming it to be "A road of aged" or " a road by proscription", neither of which fits because it did not even appear on Mrs. Davis' deed until 1996. Facts, my dear.

Anonymous said...

The only ones who are venomous are those who are causing problems for others and attacking here since they have no real case.

Really? What exactly does that mean? Causing problems for others? Who is that - the bloggers who have to share space with people with different opinions? Attacking?? It seems the attacks have all been one-sided and anyone lending a voice of reason is viewed as an "attacker". I don't know all the people at the lake either but I do know that the Atkinson Police aren't in the business of arresting people just so they can read about themselves in the paper or this blog. Clearly probable cause was in place. Despite the position of the half dozen people who feel compelled to believe so, we are NOT in a police state, and I have a hard time feeling the same level of outrage as the full-time bloggers. If you're being arrested perhaps you've earned the privilege.

I can hear those keyboards clicking already...

Anonymous said...

Mark, You should stick to topics you know something about. Rights of way is not one of them, clearly.

MAcciard said...

Really? Well, lets see; Maggie's deed specifically refers to " the Stowers plot plan of 1924" No ROW there. Mrs. Davis' deed was changed by the previous owner in 1995 to add in a prospective ROW, where Maggie has built her driveway. ROW is still in the possession of Mrs. Davis, as it is annotated on her deed, but never granted to anyone. BTW, Mags the "road of aged, or by proscription argument" requires that the "road" be in "regular and constant use", and "commonly known as an access" for a period of not less than 20 years, to qualify. Sorry.

So does your argument mean that I can build on your property, because your deed shows a ROW where your driveway is? Hmmm. And where does "right to pass and repass over a ROW" allow you to cuts old growth hardwood trees, grade, gravel, and pave?

I'm still not sure why the issues the Osborns are having with their neighbors have become so important to all of you people. This is an issue between the Osborns, the town and their immediate neighbors. When did it become appropriate to bash this family? I was at market basket too that day, I knew I rocognized the shorter of the 2 men, it was DDet Farrar and the white hair man was our fearless leader Leon. I think leon had a couple too many drinks that day as he continually harassed the most ethical straight shooting cop Atkinson has.

Leon you weren't driving from plaistow to atkinson under the influence of alcohol were you?

Anonymous said...

If you want Maggie's 15 minutes to be up perhaps you should stop writing about her? But then, nothing makes you all happier than to continue writing about her. Whether the Osborns were right or wrong - and believe me, we all know where you stand - the fact that you continue to drag their names around like this fuels the confrontations that lead to people being arrested. Perhaps letting the legal system run its course instead of being vigilantes would be appropriate? Or does that make too much sense?

You are the average of the five people you associate with the most, and that's a large reason why most of the town doesn't want to associate with this lynch mob.

That's a pretty ignorant statement about Mr. Artus. If all you can do is to attack people here, why don't you stay away? Very nasty of you.

What about the depression meds he's been taking for years? I don't think anyone should be carrying a gun if they are depressed and medicated. It's a liability issue.

Anonymous said...

yeah, one could lose it in the snow.

Anonymous said...

"if they are depressed and medicated."

It is your type of ignorance that puts a stigma on a perfectly treatable condition. There are a wide range of medications and treatments for depression. You'd probably be surprised how many people you know are being treated and you are not aware of it.

I know depression and believe me, I'd much rather be sitting next to a person with a gun who is being treated than one who is not.

Let me give you a short list of people you know of who suffer or suffered from depression. Do you think any less of them because they do: Buzz Aldrin, Woody Allen, Terry Bradshaw, Art Buchwald, Drew Carey, Jim Carrey, Dick Cavett, Winston Churchill, Calvin Coolidge, Rodney Dangerfield, Kirsten Dunst, Harrison Ford, Ernest Hemingway, Billy Joel, Ashley Judd, Abraham Lincoln, Martin Luther, Michelangelo, Isaac Newton, Gwyneth Paltrow, T. Boone Pickens, Jr., John D. Rockefeller, J. K. Rowling, Rod Steiger, Mark Twain, Kurt Vonnegut, Mike Wallace, and Tennessee Williams.

This is a fraction of known people who are or who did suffer from severe depression.

Go to the Library and borrow a biography of Abraham Lincoln. Perhaps one of our greatest presidents suffered terribly yet he was able to save the Union.

So, get a little education before you start throwing out statements that are no good for anybody.

Anonymous said...

Is it any of those peoples job to carry a badge and a gun?

Anonymous said...

You can bet the answer to that question is yes.

He didn't have a badge but Boris Yeltsin suffers from depression and he had his finger on the button.

The most common form of self treatment is alcohol. You think there are any cops out there that might be alcoholics?

Suicide is common end result of untreated depression. According to the Law Enforcement Wellness Association suicide takes more officers lives than homicide (1), and one study found the rate of suicide among officers to be three times the national average (2-3). Ignorance and stigma prevents these officers from seeking treatment for a condition that can now be easily treated.

Treatment is often not sought because many people are reluctant to discuss or seek treatment for depression due to social stigma about the condition, or due to ignorance of diagnosis or treatments.

It is your type of ignorance that causes the stigma. Try reading a book sometime.

Oh, by the way, a major life event is often the trigger for a depressive episode. Divorce, loss of a loved one, losing your job are common ones. Think you're immune? Wait until it happens to you or someone you know. At least you will know you're in good company.

Dear October 4, 2010 8:36 PM, thank you but I'm done. Ignorance is a very hard thing to correct and I have no expectations October 4, 2010 8:56 AM and his like will have learned anything. Given that, I truly appreciate your comments.

Let me add one other thing about depression. Imagine that one day a gray cloud surrounds you and causes you to lose all happiness, in anything. Anxiety becomes your constant companion. Alcohol provides some relief, but alcohol itself is a depressant and makes things worse. Suicide suddenly seems a viable solution. You start thinking of effective methods. Men have a higher success rate at suicide because they are more willing to use more violent means.

I know this because I suffer from depression and will likely be on medication the rest of my life. In my case heredity is probably a factor. You could say I was doomed from the start. But, you know what, thanks to the treatments available today I can again enjoy my family, appreciate what I have, enjoy my hobbies, helping others, and continue to hold the same job I held when I was struck, and I've excelled at it. I have the bonuses and performance reviews to prove it. Without treatment I could have just as easily left a spouse alone and child without a parent.

So, just pray it never happens to you, and pray I don't catch you (October 4, 2010 8:56 AM) in public disparaging a person who is suffering from depression or being treated for it. Be prepared to be educated.

Woody Allen married his step daughter. Now there's a picture of morality. Ernest Hemmingway committed suicide. Ashley Judd was arrested for shoplifting. Isaac Newton was unsurped by Einstein.

Most of those you mentioned are actors or politicians. None are cops.

First you attack a person and acuse them of drinking, now you defend another saying he's on meds for depression but that's ok. Don't you see the double standard that you are applying here?

That was my point in bringing up the fact that the copper is no better. He was screaming at the other man, not indicative of controlled behavior or evidence that his meds are helping the way they should be.

Get my point now?

Anonymous said...

October 5, 2010 9:19 AM

First, I accused no one specifically of drinking. Second, I was trying to give you some information, which unfortunately didn't seem to register. Third, you assume the medications one is taking is resulting in violent behavior. I will admit that will happen when people self medicate, speed, crack and alcohol being common ones.

I'll also let you in a little secret. All those who post here anonymously are not the same person.

But, you are easy to identify. Your continued ignorance is like a beacon.

Finally, Woody Allen I have no comment on. One behavior is not always the result in another. Ernest Hemingway suffered from alcoholism and depression. Did you hear me when I said suicide is often the final act of a depressed person. The treatments available today were not available during his lifetime.
And please, clarify something for me. I don't believe Issac Newton and Albert Einstein knew each other, having lived about 3 centuries apart. Are you saying Newton knew of Einstein's work and that caused his depression?

So please, share with us more of your relevant examples and expert knowledge of mental illness.

OMG, a man yells at another man. One must be insane. Take my advice, stay out of New York City. At least half the population must be crazy using your standards.

Let's see...the cops all say, can't arrest anyone unless the boss ok's it personally; they don't publish the police log cause they don't want anyone to know what is really being reported in town - if they did, they'd be accountable. They pretend they see nothing when they respond to calls; they hire old men to pose as police officers; they run around town bad mouthing residents who ask for services; they aren't doing anything constructive for the town, collecting a check until they cross the boss then they get forced off the squad.

Cushy job. I wonder when something is going to happen to crack this scam wide open to the clueless.

Okay, so we have a single topic blog. Not exactly what has been advertised. This rail layover yard is a big issue that will affect many Atkinson residents. Why don't you want to chat about it? Hmmmmm.

Anonymous said...

I'm thinking it's because the subject here is another innocent person has been arrested by a "Tin Foil" badge on a "Tin Foil" Chief while protecting the Osborns! Stick to this subject or write your own article and ask for it to be a submission article.

Are you so lazy that you want someone else to write it for you? You must have graduated from Timberlane.

Anonymous said...

Anon 6:55 AM,

Stick to the subject? That's a laugh! All of the posts on this blog are un-moderated and as a result, threads are constantly hijacked and go off topic. Despite the warning, personal attacks are allowed and the only thing the "Atkinson Reporter" used to be good at is cutting and pasting from the Eagle Tribune. But given the number of Atkinson-related articles in the Tribune as of late that have not made it in here, it appears he/she is not too interested in doing their job anymore.

Anonymous said...

Article Submission: Please post as new:
Efforts by NH DOT, Mass DOT, MBTA, Rockingham Planning Commission and various officials of Plaistow have led to an application for funding to convert the old Westville Homes site to a rail layover yard with 6 sidings for passenger trains. This site in New Hampshire appears to be the trade-off for getting passenger trains to stop in Plaistow to pick up commuters.
The problem is that the layover site they chose is on the edge of a large wetland where Bryant Brook runs through and forms the border between Atkinson and Plaistow. It is one of Atkinson's Prime Wetlands, as voted by the Atkinsonian Voters. The proposed yard is a few hundred feet from many of the condos at Bryant Woods. Residents of that area are justifiably concerned about how their homes will be affected by noise and air pollution. Other sites were considered in Plaistow and Haverhill, with the potential for less impact to neighbors. Documents relating to this topic can be viewed at the Atkinson Selectmen's office. Please educate yourselves, and share your ideas; is this a good thing or a bad thing for Atkinson?

Anonymous said...

To answer a previous question, the police log is not routinely published in the newspaper, in fact it is usually not published along with all the other surrounding towns. Not only is it not published, it doesn't contain the same level of detail that the other towns publish.

Why?

Are they so special that the criminals in Atkinson can't have their names and addresses in the paper? Why is the PD protecting them? This is how the PD has been doing this for years and it hides the crime and the criminals from the rest of the the town.

How do you like not really knowing which house the vandals, thieves and stalkers live in on your very street?

You'd be surprised to hear what your neighbors have done and it's being hidden from the public by the very people who are employed to protect the town.

Just another example of a "Tin Foil" badge on the shirt of a "Tin Foil" police Chief covering his tracks of a do nothing police dept. Nothing that is but a "Tin Foil" police dept. arresting innocent taxpayers to cover the tracks of the "Tin Foil" CON-sentino.

This corrupt police dept. must be disolved and turned over to Plaistow. After that has been accomplished, taxpayers can go after the do nothing selectmen.

Anonymous said...

My fear is that something bad will happen and we will have no real police protection to rely on.

Anonymous said...

The real fear is that the existing Atkinson Police Dept. is allowed to stay in existence, where your "Tin Foil" police chief, Farrar and Baldwin is ALLOWED TO ARREST INNOCENT TAXPAYERS, to protect people that donate to the police dept. charitable account.

That dept. will arrest you in a moment for even questioning where the money comes from. NO taxpayer is safe from arrest by CON-sentino.

Do not fear, just join the effort of the honest people to dissolve this police dept. and turn it over to Plaistow's Chief Savage. If that doesn't work, dissolve this police dept. and mandate that the State Police come in when called!

There is NOTHING TO FEAR BUT FEAR ITSELF! Don't fear CON-sentino unless you leave him in POWER!

Doing nothing will be our demise!

Cut the BLOTTED police dept. budget, CUT the police dept., CUT CON-sentio, CUT police dept. donation account, which will CUT CON-sention's ABUSE OF AUTHORITY and PROTECT YOUR PERSONAL ABUSE OF YOUR PURSONAL RIGHT!

There is no downside to this argument.

CON-sentino isn't protecting your rights, he's being allowed to take your rights away.

JUST SAY "NO" TO "CON-sentino and the Taxpayer "CLOWN CAR" he rides in.

We have the POWER, now WE HAVE TO USE IT!
