Electioneering, the sequel to the sequel of the sequel.

As it does every election season, this Issue once again rears it's ugly head. And, as always the prime practitioner of this lost art is our Chief of Police! Yes, the very man charged with UPHOLDING THE LAW.....(chuckling).... sorry, could not contain myself at that phrase applied to that man. Many will remember the Chiefs admission that he had petitions signed in the Elderly Affairs cruisers, and that he had people come down to the Pd to sign petitions for his warrant articles. Many more will remember that the Chief of Police owns a private non profit corporation, that although it is not affiliated with the town, and is not accountable to the town for its contributions and spending, is housed in the PD, uses PD personnel, equipment, time, space, and the Elderly Affairs customer list to do it's fundraising. These are valuable town funded resources unavailable to other non profits in the area. Well word has it that another non profit in town has petitioned the selectmen for "equal access to town resources". So far the selectmen have declined to either grant this request or acknowledge the chief's use of his official status for personal political purposes as well as for his own non profit's success. Surely if any other business in town used taxpayer funded town resources for their own gain, there would be an uproar, and the selectmen would put an immediate stop to it, but somehow when the transgressor is the Chief of Police, the public and the selectmen are unusually quiet. So much for their fiduciary responsibilities. It is high time that these quasi illegalities stop. The Chief has spent decades driving a truck through loopholes in the laws, and crowing about this immoral ability of his. This column would admonish him to act honorably, but it has become apparent over the last decade that this unappointed, unqualified, interlocutor has no understanding of that term.

This is appalling to hear, but doesn't surprise me that taxpayer dollars are used for this. Doesn't surprise me either that selectman know what's going on and do nothing about it. The whole town is illegal. One of these days they are going to get caught. It just takes time.

How can you expect the Selectmen to enforce Electioneering RSA's when Firel himself violated it by using his Town email to promote his campaign? Yes, in case you did not get such and email, there was an extensive list of residents who did.

I am going to vote Republican for Governor and he gets to appoint a new Atty. General. This one doesn't seem to get what is going on here.

The Attornies General Elections division has been given 6 reports that I know of, by 6 different people over the last 5 years About Phil's electioneering.

They have "opened files", but done nothing.

If there is proof of electioneering, and ethics violations by all, and Attorney General is not doing anything then why don't you get the people who know this information factual and do a Class action lawsuit. There are plenty of attorneys in this state that would proabably love to sue the Town Municipality and also the State of NH for not following thru on complaints or reasons per Ethics codes that they created. Why haven't you gone higher strait to the Gov with your findings if you don't want to do the State and Municipality lawsuit route. You will have to wait to see who wins that seat now because no one would look at a complaint now. Just a suggestion. I do know from experience not with this forum that I had to keep bugging AG constantly in Writing for my scenerio to be addressed. Alot of hard work but it pays off, depending on how much you want to put into it. Sounds like you need another complaint lodged to them with copies of all 6 reports attached for prior. That way you cover yourself for a potential lawsuit with backup. Just do something.

To 6:29pm; Speaking as someone who has brought suit to force the Chief to obey the law, I can tell you it is not worth the effort.

It takes a year to get to court. During that time, the towns $500/hr. insurance company attornies will pepper you with filings. They will attempt to make each separate paragraph stand as a cause of action on it's own through Summary Judgement Motions. You will be deposed, more than once. EVERY ASPECT of your life will be examined in an attempt to impeach your testimony.

The Chief will lie about you on camera in selectmen's meetings for a year. He will sue you personally for slander, dropping the case two weeks before trial, AFTER causing you to spend thousands defending this frivolous action.

YOU, your wife, and any kids you have that drive will be followed through town by Phil. he will cruise past your house 4-6 times daily, slowing down to look around.

When you bump into him at the village store, he will conduct a walk around inspection of your vehicle, looking for something he can give a ticket for. He will verbally threaten you.

Throughout all of this the selectmen will look at you and say; "But it's the chief" and do nothing.

If you own a business he will investigate that. He will call the DMV and pull your vehicle entire history from the time it rolled off the lot in Illinois. He will call you customers and suppliers and tell them you are "under investigation by the police".

AND FINALLY, People outraged from listening to his lies will gouge every body panel on your gorgeous Chrysler 300 down to bare metal as it sits in your driveway. They will spray paint your house while you are out of town.

All the while the selectmen will do nothing.

TRUST ME IT IS NOT WORTH IT! Accept that he is a police chief who violates the rules, and wait for him to retire.

To 7:00am I am truly sorry this disgusting behavior happens in our Town. I guess when I suggested how to move forward it was for something I had to do to get my answers, which had nothing to to with Town politics, just a different scenerio with AG office. After reading this he is more disgusting. I have heard, and read here say about him and most people in town are afraid of the bully who claims to run it. You have to believe what goes around comes around. Yes to 7:26 he will never retire, he will try to go out as a martyr. The Elderly have no idea what really goes on. They are trusting. You may never see it, but if all is true, as you say and others have written, he will someday meet his maker and have to answer for that. I think that is far more punishment then any of us could do. I do believe in Karma.

8:30 AM , A martyr dies for his cause and his cause is his only. If he were a martyr in the sense of politics the town wouldn't be where it is now with the decent and corruption within it confines. A martyr dies for the common every day majority for what ever the cause and not for ones self. The chief is not a martyr and will never be one under mans or Gods laws . He has done to many things that are negative to man . I wont say under the laws of God but will say he will be judged by Him. If the selectmen are the peoples voted majority then God help us all because they haven't done under sworn oath what they pledged to do upon their entering office. Time is now for the change of their actions or they should leave office by voting them out or by their own resignation[s]. Enough is enough and it is time now to rid the shame of the town that is known through out the state and beyond. Yes it is Halloween time once again . Lets not have another fiasco that has already taken place.

Listen Phil, you misquoted the case, as usual. The portion you are quoting, was applicable to the blogger's attempt to withhold the identity of his source, for information that appeared on his blog. NOT regarding his postings themselves.

Second, As you learned in the past with me, TRUTH is an ABSOLUTE defense against charges of slander.

I'm not involved in the happening so I have a question or two for you. Are you still in fear? If your not then say so here and post what you did see with anonymous status. To say your appalled and sorry to Mark is all well and good but you do have choices of making amends for your lack of action at that time. If you state your knowledge and opinions here and others do the same then may be ,just may be, the selectmen will do the job they should have done long ago. Are they in fear of confronting the towns problem? If so, then they must be part of the letting these problems continue on with out resolution. Now is the time to band together on site and force the action to resolution by demanding the BOS do its job. By ding this it will force them to resign or do what is right. There is nothing like a majority being the squeaky wheel that has to be greased to stop the problem of its noise .

Be what is above is true or not the majority will rule. The majority has to make them selves known. The way to do this is here on site. If everyone who blogs here responds within an agreed time set by those who write here to respond then there will be a showing of what the majority wants to happen. How many of the taxpayers can be prosecuted for any supposed violation of the RTK laws,etc. and any complaints by the minority that they might try to bring forward. None! Now lets agree to a time span to do this by some one , possibly the administrator , or just let the towns abusers continue on doing what they are doing.

I remember a former selectman named Wayne Peak, way back in the 1980's, right after Phil was made Chief, found that money collected by the PD for reports and stuff wasn't being given to the town bookkeeper, but was being donated to the Atkinson Patrolmen's Association. He raised hell with the selectmen, and they refused to fire Phil. Peak sued the town, and Phil sued him. Case lasted 6 years, cost hundreds of thousands, and were mysteriously settled in the late 1980's. Peak help a big party, open bar at the N. Andover KofC. Claimed it was paid for with his winnings.

My point in remembering all of this, is that Mark's troubles are not the first time Phil has don these very same things.

I suppose any one could but the persons that were hurt the most by the chief or other town officials should. I say this because of the well known past things that have happened to them. They had no fear of the chief and the others in public ,the courts, and in all the media forms we have today. A banding of these persons to collectively join in the action would be a great way of getting things done once and for all.

My suggestion was not to ask the BOS when is appointment expires, but to ask them if there is any existing contract between the Town and him. Something that guarantees his job or offers monetary settlement. Any agreement about public employment is public information.

12:27 , It doesn't mean the state is now democratic. What it means is that the people voting whether Rep,Dem, or Ind are fed up and want a change in government overall. Ex.Bass got beat didn't he? It is time the pols got the message is it not? The message being DO THE PEOPLES BIDDING NOT JUST YOUR PARTIES DICTATES! To 12:27 AM - If you knew anything at all about finances, you would realize tha Alaska is in the black and that each citizen reaps the benefits of their oil trade. They are energy independent because they own large reserves. Moving there is a smart move. You can stay in NH and shoot moose too but I assume you will not have enough money to get up north after you spend your unemployment check on food.

11:31 , The "live free or die" use of the saying is a reference to General Stark to those who he addressed at that time. No where was it meant to be as it is used today and I'm tired of hearing it be put into the politics of our state. We all have a price to pay to stay free but it isn't as the saying is now used. The price is the taxes and other charitable means and ways of paying to be in a civilized society. How would you like to live in the Lawrence/Haverhill area and then use that saying as you have? What you'd be saying is to do what ever you want to the crazies to kill or hurt others in protest to law and order. You wouldn't last to the end of the day with out being hurt or killed. You cannot compare Atkinson to Lawrence or Haverhill. The tax base and services are completely different, nor is it relevant to the discussion of how the State of NH has changed from the simple rural country life to one with high taxes, little services and low expectations. This influx of dems to NH is raisng our property taxes and it does not fit the lifestyle that we came here to enjoy.

2:36, The subject was the use of "Live free or die". You say no one should use the comparing of Atkinson to Lawrence/Haverhill and yet you do forget how close they are in proxsimity to Atkinson. Do you think that there is an invisible fence to protect the towns people from these things of criminal happenings? When they can no longer get what they want in that area they'll come here out of want. The tax base and services and how they are made isn't the question here, the nimby attitude is. Your blind not to see that especially when there is corruption in the towns politics including its services. EX. the constant elderly affairs head using the position to influence the elderly. The inferring that there will be no more elderly service if they do not listen to him. A BOS that will not do their job to correct the towns internal problems . [I wonder why that is]. Your statement of "simple country life,etc., etc." just goes to show that you are stuck in the old days and don't want to come to the current times of the modern world. Do you really think it shouldn't or doesn't cost you to have come along this way in time that you now enjoy. To 8:09, When the crazies from Lawrence and Haverhill start coming to town to commit crimes then will you say they were to far away from here to come here? You say there is a nimby attitude towards the selectmen every day. Apparently your not that educated in what has gone on up to now. If you were then you'd ask the same questions of them as has many here on site have done. Some of them have had to deal with harassment,courts,damage to personal and real properties, and some ones business, etc. The causes of actions are well known as are the participants in all these things written here. Stop trying to not see what is truth unless ,and, of course your one of the guilty or a close relative of them. The BOS should be ashamed of themselves for not taking the stand and act as they should to clean the towns slate in these matters . They did take an oath to represent the towns best interests did they not?

To 8:09 - I came from Mass, just like a lot of other Atkinson residents. It is not about where you come from, it is about the quality of your character.

I am also very educated about what is going on in Town and I am one of their victims but I still am not going to lower myself to your level and rant on here, day after day when you have nothing new to say. That's how you tune people out to your message.

We have plenty of criminals here in Atkinson so stop worrying about who may come into Town. You sound like the Chief riding borders on Halloween.

Whether or not the police services are need for any of the public they have to do their job. They may know who is anti police or for them but they still have to act to give the service they provide equally each day of the year . Get off your soap box trying to instill fear among us.

I'm happy to see that the AR2 Monitor has removed the profanity and it was never my intention to cause a problem by writing on the subject of the profanity. I did make it known that I didn't like the reference to the four letter slang word used by the wacko and his use of the word guys when making his vile disrespectful commentary to both sexes. What I'm really interested in if you will go and do what was asked earlier on this site. - The question is and was will or are you going to see if the towns computer[s] were being used and by who the person[s] are using them? Also were you going to bar those who are violating the site with their outrageous stupid and filthy writings on this site? The cat comments are a minor example as compared to the other things already mentioned but most of all who is doing these things. In exposing the persons it would help the town and its people to over come its stigmas and bring back civility that seems to be lost because of the few who hide behind being anonymous on this site. Will you quietly use your right to expose them and ask that the selectmen do their job as required by the oath they took in representing the towns people. The probable firings and/or forced into retirements are needed here to stop what has gone on for far to long. JMHO

A law change aimed at making sure prosecutors tell defendants if police officers set to testify against them have credibility problems went into effect virtually unnoticed five months ago, but it is quickly generating controversy as defense attorneys disagree with the state's interpretation.

Deputy Attorney General Ann Rice said she only learned last week from the Sunday News that Rep. Brandon Giuda, R-Chichester, tacked the amended law governing the confidentiality of police personnel files onto unrelated legislation at the 11th hour after it failed to pass as a stand-alone bill.

Giuda, an attorney who lost his seat in Tuesday's election, said he made changes to RSA 105:13-b because he passionately believes people accused of crimes should be informed if police personnel records contain information that could hurt an officer's credibility as a witness.

"I'm a law-and-order guy," Giuda said, "but I've seen abuses by law enforcement."

Giuda said the old law was unconstitutional. Police and prosecutors had been relying on a 2004 memo by former Attorney General Peter Heed in determining what to turn over from police personnel records, Giuda said.

Now, if police and prosecutors fail to disclose such material - which includes lying under oath, theft, fraud or any conduct that could affect an officer's truthfulness - they will be in violation of state law, Giuda said. He would like the law further amended in the future to include penalties if they fail to do so.

People should focus on the fact that "the U.S. Supreme Court ruled 50 years ago and in many subsequent cases that prosecutors and police officers have a duty to disclose this evidence," Giuda said.

"'Laurie' just happened to be one New Hampshire Supreme Court case, but this constitutional right (to those accused of a crime) has been identified since the 1960s. And the fact that some don't know about it now, or are not complying after all this time, is really telling."

In the 1993 case State v. Laurie, a first-degree murder conviction against Carl Laurie was reversed after he was sentenced to life in prison because the state didn't tell the defense that the lead police detective's personnel file contained matters that called into question his truthfulness.

Laurie ultimately pleaded guilty to second-degree murder. Now 62, Laurie remains in State Prison for Men in Concord and will be eligible for parole to freedom in two years.

Giuda's crusade began when a fellow lawmaker told him an unidentified police chief confided that other chiefs were hiding Laurie information and not disclosing it to defendants, something long required by state and federal court rulings.

The amended law says: "Exculpatory evidence in a police personnel file of a police officer who is serving as a witness in any criminal case shall be disclosed to the defendant." It adds that disclosure is required even if a defendant is not found guilty.

Several defense attorneys said they view the change as requiring prosecutors to personally review police personnel files to determine whether they contain Laurie material and define "exculpatory'' to mean all evidence favorable to a defendant. Rice said she defines exculpatory as evidence that could show a defendant is not guilty.

On Wednesday, Rice sent her analysis of the new law to the 10 county attorneys, who along with her office are responsible for maintaining confidential lists of police officers with potential Laurie matters and for disclosing relevant information to defendants.

Rice told them that it appears the law differentiates between exculpatory evidence and evidence in the 1972 U.S. Supreme Court case Giglio v. United States. The high court ordered a new trial in Giglio because the prosecution failed to tell jurors that a witness was promised he wouldn't be prosecuted in exchange for his testimony.

Charles Temple, a University of New Hampshire School of Law professor, said Rice's analysis is wrong and doesn't make sense to him.

"The duty is on the state (police and prosecutors) to disclose Laurie materials," Temple said. "Giglio is an entirely separate issue related to the disclosure of plea deals for state witnesses."

Manchester defense attorney Cathy Green agreed with Temple.

"All evidence that a police officer is not credible is in my view exculpatory," Green said.

Concord attorney Jim Moir, who represented Carl Laurie at trial, said he doesn't understand Rice's analysis, either.

Moir started the ball rolling on Laurie's appeal years ago when former Merrimack County Attorney Michael Th. Johnson told him about the credibility issues in the lead detective's personnel file. The state argued unsuccessfully to the state Supreme Court at the time that the information didn't have to be disclosed, Moir said.

"I am sure that members of the defense bar will be filing motions for orders that personnel files be reviewed by the prosecutors themselves, as it is their obligation to provide the information," Moir said.

A man who was convicted of second-degree assault last month in Rockingham County Superior Court has asked Judge N. William Delker for a new trial, arguing that his lawyer, Neil Reardon, didn't tell him a state trooper who testified against him had a Laurie issue for lying under oath at a hearing.

The names of officers on Laurie lists are strictly confidential, but Trooper Derek Holston's name became public when he appealed the 11-day unpaid suspension he received after it was determined he had lied at an administrative license suspension hearing.

Clint Pickering, 29, who was previously convicted in federal court in connection with the 2009 Bank of New England robbery in Windham, was convicted Oct. 1 in state court of running over a Windham police officer's foot during the getaway.

He wants to fire Reardon and get a new trial. Reardon declined comment last week.

"Everything (Reardon) advised me not to do hasn't worked out," Pickering said in a telephone interview from Rockingham County Jail in Brentwood.

In a motion seeking a new trial last week, Pickering wrote: "If defendant knew about Holston's Laurie issue, he would have had a chance to suppress his statement."

Rep. Giuda said he started researching Laurie disclosures at the prompting of Rep. Paul LaCasse, R-Claremont.

"I would have never known except that a good police chief, an honorable chief, pushed the issue with Rep. LaCasse," Giuda said.

I. Exculpatory evidence in a police personnel file of a police officer who is serving as a witness in any criminal case shall be disclosed to the defendant. The duty to disclose exculpatory evidence that should have been disclosed prior to trial under this paragraph is an ongoing duty that extends beyond a finding of guilt.
II. If a determination cannot be made as to whether evidence is exculpatory, an in camera review by the court shall be required.
III. No personnel file of a police officer who is serving as a witness or prosecutor in a criminal case shall be opened for the purposes of obtaining or reviewing non-exculpatory evidence in that criminal case, unless the sitting judge makes a specific ruling that probable cause exists to believe that the file contains evidence relevant to that criminal case. If the judge rules that probable cause exists, the judge shall order the police department employing the officer to deliver the file to the judge. The judge shall examine the file in camera and make a determination as to whether it contains evidence relevant to the criminal case. Only those portions of the file which the judge determines to be relevant in the case shall be released to be used as evidence in accordance with all applicable rules regarding evidence in criminal cases. The remainder of the file shall be treated as confidential and shall be returned to the police department employing the officer.

I feel it should go beyond just that alone. The questions put forward by this person about the towns corruption and the lack of the BOS to take action is paramount to the needs of the towns people . Then you have to consider the taxpayers who have had to pay their share of the bills of the many suits that have been settled so far. Please don't think the insurance company paid for all the damage awards,you the taxpayer did. The rates for the towns insurance have risen and its not just the cost of living factored into the cost. Wake up and insist on the BOS do its job once and for all.

What we have here is a person who has been blogging about a specific individual for well over a year. This is the same blogger who is responsible for the cat comments and who has been "threatening" others with threats of visiting their street at night. This blogger has also accused a specific individual of sexual crimes.

We have invited the blogger off this site on many occassions but they persist in slanderous harassment of individuals.

In an effort to reclaim this blog for it's intended purpose, the ip address of the blogger has been turned over to the victim with corroberating evidence.

It wasn't that long ago when a white person called a black person the "n" word it was more than offensive to a black person. But when in recent times a black person calling a black person the "n" word wasn't offensive to the black person getting called the "n" word. What am I missing here? I have long suspected the moderator had the ability to determine the IP address of an anonymous blogger. From that point it is really not that hard to determine that person's location, then their identity. This is fair warning to everyone here, you can be found by the moderator if he wants.

"Shouldn't you be concerned?" I hear you say. Not really. My current IP address is in Panama. Could be someplace halfway around the world tomorrow if I choose. I never, ever, come here when using my assigned address. A word to the wise.

Administrator, Lets see if 6:03 PM is telling the truth or is just blowing us an attempt to make a big smoke screen when he says he/she is using another IP address outside the country when they blog here. If they are lying then post him/her on the site with their true IP address. That should stop all the foolishness here and expose the liar for all to see.

It's ridiculous for anyone to assume they are completely anonymous and it doesn't matter if you log in from Panama or Nepal or Spain.
