Let the whining commence, as history repeats itself

At the Conflict of  Interest committee hearing this week Mr. Consentino, once again, engaged in a collossal  display of whining that would put a 3 year old to shame. Proclaiming his  innocence as he has in every case in which he has been ordered to  obey the law, and whining that the "committee is stacked against him"

NEWS FLASH: Perhaps if you stopped violating the law, various boards, committees and Courts would stop finding you in violation of  the law, and on a side note, wasn't enforcement of the law your primary career? Odd for  one who has transgressed it so often.

HISTORY: Mr. Consentino's illustrious town tenure has been almost constantly marked by controversy, and legal fees. Mr. Consentino has cost the town more than any other individual inn history, costing the town(and it's insurers) hundreds of thousands if not  millions in legal fees and settlement costs for his various perfidies.

He began his career as Chief with a six year legal  battle with former selectman Wayne Peak. Mr. Peak found that Consentino had been giving fees collected by the PD for reports, etc. to the Policeman's assoc. not  the town. Although the entire issue could have gone away if Consentino had simply said, I am sorry, it was an oversight. Instead his response was "my name is a pure as the wind driven snow" and " I am not going to stand here and take this". The conclusion was  rumored to be, at the time,  the largest civil settlement in NH history, as Mr. Peak had a huge party at the K of C in N. Andover. Officer Pat Judge quietly closed the association and gave the money to the town, demonstrating the honor Consentino evidently lacked.

Over his tenure he has been ordered by the NHPELRB, NHPSTC, Rockingham superior  Court(a number of times) and the conflict of interest committee to  obey the law, and he still can not  apparently do so.

He also was recently FIRED FOR CAUSE, said  cause being the serial sexual harassment of a female  employee, in which he was allowed to settle to avoid prosecution, which settlement cost the town $100,000+.

it is following this sordid history that Mr.  Consentino finds himself before the conflict of interest committee AGAIN, FOR THE EXACT SAME THING Rockingham Superior Court ORDERED him to cease and desist from. VOTING upon matters in which he has a conflict of interest.

Hey, Phil, if  you stop violating the law, committees will stop finding against you.

Ego run amok, and as always THE TOWN PAYS!

The Conflict of Interest Committee tried to be put on the Selectmen's agenda for Monday March 2nd but was denied and put on March 16 which is after the election. The committee wants to present the findings and recommendations before the election so that the people are informed. This appears to be a protection of Consentino so that he will be elected.

The guy keeps getting elected because he wins with VOTES by the majority, so for someone to post this story about Phil whining is a joke sounds like the publisher of this story is the cry baby to me.....Remember no matter what his history is the voters have spoken and voted him IN, for you to cry foul is just sour grapes and a story like this can only be posted to do one thing SWAY VOTES in "Your Opinions" favor, funny how you post this right before election time huh?....I have more destain for people playing nose bleed politics then I do of this candidate and all his problems, that tells me you are trying to BS me and sway that vote against this guy....do me a favor "LET ME THINK FOR MYSELF" we have enough Donna Greens and Mark Accairds in this area.

DJust getting elected by elderly and others bought off by favors and donations over many years does not turn a pig into a saint. He still violated state law again and again and again and it is time for the court and Attorney General to determine remedies and punishment. I think removal from office is the only remedy that will stop the abuse of state laws permanently. That's the only way to stop a habitual abuser and harasser. This blowhard has cost Atkinson taxpayers millions in lawsuit payoffs and legal fees. Not to mention the very recent $100,000+ award that resulted in the termination of his position. Also he was NEVER supposed to work for the town of Atkinson ever again. But currently gets PAID AS A selectmen causing more damage to the town. THAT must STOP.

Please have this opening statement published in the Eagle Tribune for readers to see. I agree that the final tally of votes will say it all. If the Conman wins the election we all lose and will continue to pay for his past and future actions of violations of law and decency to the town. I can only imagine what the tax rate would be if he were to have been ousted prior to this time. If the lawful powers couldn't or wouldn't remove him from the scene then you can by voting him out in this election.

Any one of the candidates running for selectman is so much a better choice than PC. This man at one time long ago when the good old boys way of running things might have worked but this has caught up to him and the cronies that want this to go on. Wake up! It's time to have people working for the taxpayer actually being fair to all and not the crone base. WE have been and will continue to be the laughing stock of this state if this is allowed to continue.
FIRED FOR CAUSE and not supposed to ever work for the town again and he is a PAID selectman. He has enough cronies that he did favors for to still get him into a position that his way of doing things will cost us all a lot of money in legal fees. No wonder we are looked at as a joke.

What occurrs to me is why all 3 selectmen were not found guilty too. All three committed the same illegal offences and acts and put a guy in as School Representative illegally. Voters may go ahead and elect violators of state law. I hear they even voted in someone that sexually harassed an employee in this town. So it's all good. All crimes allowed. The voters may prefer criminals over decent citizens because the are not allowed to see the truth of the crimes. Thank you, Eagle Tribune for your bad service to us citizens. I wonder if they will even print the guilty verdicts.

CONFLICT OF INTEREST COMMITTEE DECISION
DATE: Feb 26, 2015

MISSION STATEMENT:
The Conflict of Interest committee was created to help control the ethical behavior of all public officials,town employees, and school districts. The Committee is designed to help take the appropriate steps to
maintain the highest level of “Code of Conduct” and the integrity of it’s government members, so that they
perform their duties without conflicts between their private interests, and those of the citizens that they
serve.

DECISION:
The committee has taken a non-binding vote 3-0, 2 members have recused themselves. The Selectmen
Phillip Consentino, William Baldwin, and Harold Morse all violated meeting procedures established by the Attorney General’s office, Department of Justice.

There is a petitioner Leon Artus with complaint of violation of Right to know Law: RSA 91-A-3 II
He states that Town of Atkinson Selectmen went into non public session for the appointment of a vacant school board position at Timberlane Regional School Board. The elected position was vacated by Atkinson member Mr Michael Mascola. Per his word, Selectman promised that all discussions would be done in Public meeting. He submitted (Video 1) along with his written request for candidacy. He states that
Selectman violated that promise by going immediately into a non public session, also submitted is Video 2.

Mr. Artus states that when the Selectmen came back from non public session that there was a vote to appoint Jack Sapia as a temporary school board position.
The above metioned videos are a portion of the cable TV videos.
The Conflict of Interest committee believes that the Selectmen do not have to keep their promise whether
meetings be public or non public as long as they follow the meeting procedures, but in this case per review of Attorney General’s office, the Department of Justice Right to Know Law RSA Chapter 91-A: Per Statute RSA 91-A:3,II (B) reads: Allowable grounds for holding a non public session are limited to the
consideration of the following matters:

A non public session may be held for the “ hiring” of a person as a public employee. The Selectman are allowed, and can call a non public meeting for personnel matters, but when there is a vacancy of an elected or appointed public office it is considered an “appointment” and is not considered a “hiring” of a public employee. Only then must Selectman interview, and deliberate, vote in public on filling that temporary
vacancy in a elected office. Therefore, all 3 Town of Atkinson Selectmen did violate this Law. See Lambert V. Belknap County Convention 157N.H. 375 (2007).

DISCIPLINARY ACTION:
The committee cautions that the Town of Atkinson Selectmen may have violated the Right to Know Law,Statute RSA 91-A:3II(B) we are recommending the Selectmen refrain from all future non-public-meetings unless they fully meet all the requirements of RSA 91-A:3.

The Attorney General has been consulted and if the Board of Selectmen continue to hold non-public meetings in violation of RSA 91-A:3 then a petition may be filled with the Superior Cour by a private citizen.

2. As a Selectman, knowingly enter into any discussion, testimony or deliberation without first,publicly and for the record, stating all dealings, interests, relationships, and possible conflicts that may exist between said member and his or her family, the principals and the issue under deliberation, as may be known by the member, with 3 of the 4 candidates applying for vacant position as a School board member.
3. As a Selectman, knowingly participate in town business without disclosing all potential conflicts of interest, with 3 of the 4 candidates applying for the vacant position as a School board member.
The committee does believe that Mr Phillip Consentino should have stated his possible conflicts with
William Friel, Leon Artus, and Jack Sapia publicly, and for the record, and request if anyone has an issue or opinions on his discussions, deliberation, voting, and appointments of a vacated school board member
position that became available before the end of the term. However, the committee also believe that Mr.Phillip Consentino does not have to publicly advertise the exact conflict with each member, as long as Mr.Constantino as Selectman announced his relationships, dealings, interest and possible conflicts with said
candidates. At that time it would have given Mr. Consentino the opportunity to recuse himself from voting on an appointed position with his conflicts with 3 of the 4 candidates and allows the other Selectmen to proceed with their votes. All submitted court documents were not considered in this decision.

DISCIPLINARY ACTION: Pursuant to RSA 31:39a, violating this code shall be grounds for recommending disciplinary action to be taken by the Board of Selectmen if found by the majority vote of
the Committee.
The committee recomends that Philip Consentino be censured and instructed to publicly state all possible conflicts of interest in the future and recuse himself when necessary.

The Conflict of Interest Committee request that the Selectmen discuss and vote on this matter in public session per RSA91-A:3(c). Failure of the Selectmen to comply with Section VII of the Conflict of Interest ordinance, the Conflict of
Interest Committee may petition and file with the Superior Court and retain an Attorney utilizing the Town of Atkinson’s Legal Line.

PC broke the law over and over, he was ordered by a Judge to stop and this did not stop him. Maybe the good citizens of this town will. Old school has cost me enough money and will continue to if he is reelected. It would be very entertaining if Leon got on and we were stupid enough to vote PC in.
Mr. Fournier had to step aside for this vote because of a conflict of interest. He has been a selectman before and a resident for I think 35 years. He would make a great Selectman and will get my support.

I have read all the posts up to now and the one that stands out is as follows. Feb.27@2:32says "no matter what his history is the voters have spoken and voted him in". Then he/she goes on to say he has disdain for people playing nose bleed politics than he/she does of the Conman and all his problems. It apparent this [he/she] person is still going to vote for the pervert who violates any laws the Conman wants to that latter become detrimental to the town and its taxpayers. If this be the way of all voters in the up coming election then God help everyone knowing they voted in this nut case we call the Conman.Today is Sunday and I wonder how many of you ,especially the hypocrites attending services, will actually hear what the clergy are saying about morals,ethics and honesty? Why go to services if you wont do what the bible asks of you is the question.

I guess History does repeat itself. Consentino did almost the same thing in a Conflict of interest committee hearing in 2004. The issue was him receiving a brand new union benefit in the 2003 contract, and he lied, claiming he had received it for "three years, since before he was selectman"

Dick SMith asked me if i would withdraw my complaint in light of the Chief's statement( LIE).

My response was "give me two days to verify it, and if what he says is true, i will not oonly withdraw it but apologize to him publicly"

I went to the town bookkeeper, and found that the ONE PAYMENT that was the subect of my complain was the only one he had received, HE LIED to get himself out of a complaint.

I wrote exactly that in a letter to Chaiirman Dick Smith. Smith and his buddies ruled no conflict. And Phil sued me for "slander, defamation, diminution of earnings capacity.

At the pretrial conference his attorney, MArk Giarrusso, told me his "client will withdraw thiis case, if you pay him $15,000"

My response was; " Tell your client if he pays ME $15,000, I wont have to air his dirty laundry in open Court"

Giarrusso asked me if I really wanted him to say that? My response was "word for word".

Phil withdrew his case two weeks before we went to trial.

These are the actions of a coward and a bully. And they have been going on since 1980

The incompetent town administrator just sat there and saw it all go down at many, selectman's meetings, recorded on camera, and now his selectmen get convicted and censored on his watch. How sweet it is! What other breaches did his lack of due diligence cause?

How much are we paying this joker anyway? Big bucks and bennies too? A Fat retirement? THAT MUST STOP!!!!

Oh, right. He just works FOR the selectmen. Not the taxpayers of the town who pay him the big money for his frequent vacations at our expense. So if he wants to screw over his own police selectmen bosses, I guess that's between him and them?

I wouldn't want to be the town administrator or the selectmen right now! Elections are coming up fast. And this moron failed to protect his bosses from a conviction and a sad, sad, ruin of reputation. And now it's on the books FOREVER !!!!!!

Uhh. To that other blog poster that talks about pig roasts....I have a question for you. What do you call a pig roast when the roasted pigs do the roasting? Hmmm. A PIG PIG ROAST?

The three intimidators were trying hard to defend Phils actions and Phil lied about when Jody resigned with Bill trying to back him up. They knew but stated it was before the vote. The three board members did not show if they were intimidated at all. Pay attention people in Town elected positions and follow the law because if these board member showed the guts we need to keep our selectmen on course they will have to. It's about time the people in this town get a government that is for all and not the select few.

Monday night the COI was going to present their findings to the Selectmen BUT THEY CHICKENED OUT! Knowing it was before Meet the candidates night and elections they CANCELED the meeting. Their afraid of a few concerned citizens doing their jobs. Smells to me. I am sure the stink will go right to the AG's office.

I have doubts about Wendy Doughty's ability to contribute anything meaningful other than smacking her lips into the mic while others were trying to speak.

The COI has been proactive in informing members of potential conflicts yet the Selectmen have not followed the regulations. All members are required to disclose conflicts yet they don't. Vote in new candidates.

Phil stated he was NOT for the Generator then why is the selectmen vote on it 3-0 on the warrant articles? Also anyone that ALLOWED the BS school article #10 to even make the ballot should be dropped off at the town line. Get ready for a huge tax increase. Sapia was appointed in an illegal closed session by our selectman and this is how this big mouth shows his gratitude? Another 800 dollars every year for ever out of my pocket which will never go down.

So! Last night the conflict committee voted unanimous that the selectman voted his town employee wife a raise. THE VOTE WAS GUILTY, GUILTY, GUILTY, GUILTY, GUILTY. Five people unanimously voting guilty on the SECOND charge of corruption. Finally JUSTICE! It was a conflict anyway cause THE WIFE worked in the town UNDER HIS COMMAND 30 years. Why was that allowed???? Big stuff here. Will the rich elderly put this violator a selectmen yet again? Oh yeah! Probably. But then what? HE CANNOT SERVE. PERIOD. He is done, finished, soon on the dung heap of town history. Cause even more complaints are on the way and will get filed against this blockhead because he insists that STATE LAWS do not apply to him. Atkinson elected town officials have gotten so used to violating or evading STATE LAW and getting away with it. They became Kings in their Atkinson empire. Legends in their own minds. --But no longer! The camera catches the evidence, new people with raw courage now file complaints. Their are new honest, impartial, members of the conflict committee, good judges at Superior Court will put the final stop to Atkinson corruption. THIS IS BIG FOLKS. Tyranny in the Town of Atkinson is on the ropes. A few more uppercuts and a strong right cross and it goes down for the ten count. Knocked out of office and straight behind bars! Charges against the remaining long time law breakers in town hall, AND THE SUPPORTING TOWN EMPLOYEES, need to be filled by courageous citizens. If you got the guts to help clean up this dirty, entrenched, corrupt sleepy little town then take up your pen and join the battle. File a complaint against conflicts of interest and bad ethical behavior you know of. As a side bennie..., you can put a stop to the financial a$$rape of the Atkinson taxpayer. SO STEP UP! Your tax bills will also go lower and lower and lower when the pick pockets and self servers are brought to justice.

Unless you want to pay a lot more in taxes Ax the costly stuff that will ADD to the budget. The town warrant articles are sometimes a joke how they try and sneak stuff in that should have been on the budget in the first place.
The School article you want to vote no on is #10. This if passed will increase our school tax burden by 14%.

We desperately need a school conflict of interest committee to handle all the corruption over at Timberlane. Wives getting put on the school payroll is a conflict of interest. Influencing the vote of the Atkinson School Representative by paying the wife $180 an hour for fake public relations work nobody needs is a conflict of interest. Then the bald head GREAT LEADER who got his so called doctorate degree from an online diploma mill, his credentials are not only suspect and need complete exposure, his behavior needs a very close examination by the new. TIMBERLANE CONFLICT OF INTEREST COMMITTEE. I hear it will be formed by the state. That's a good thing.

Definitely the honest, justice loving, non prejudiced open minded people on the Atkinson Conflict of Interest Committee are voting with total integrity and the result is Driving the crooks and criminals from Atkinson CRAZY WITH ANGER.. I hear a new complaint coming soon will blow this town wide open and end in jail time for one town employee. Who will it be? Who will get fired? Who will get stand before the Superior Court Judge? Who will spent their retirement years staring at cold sharp barbed razor wire?

CONFLICT OF INTEREST COMMITTEE DECISION

DATE: 03/07/2015

MISSION STATEMENT: The Conflict of Interest Committee was created to help control the ethical behavior of all public officials, town employees, and school districts. The Committee is designed to help take the appropriate steps to maintain the highest level of “Code of Conduct” and the integrity of it’s government members, so that they perform their duties without
conflicts between their private interests, and those of the citizens that they serve.

DECISION:

The Committee had a complaint issued by Petitioner Mr.Leon Artus, and was scheduled for a hearing on 02/24/2015. At that time, the Respondent Mr. Phillip Consentino stated on video and also recording to the COI
committee that both his son, and his wife had submitted their resignations prior to his vote on the Police contract. The selectmen meeting was on December 1, 2014 for the first motion that all union and non-union police employees would get the same rate of pay increase. The second Selectmen meeting was on December 15, 2014, a motion was made to revise the motion made on December 1, 2014 to reflect that the union, and non union would still get the same pay rate as stated in the union contract, except step increases are only for the certified Police Officers.

The committee advised Mr. Consentino that his hearing dated 02/24/2015 would close until further proof of the resignations were submitted to the COI committee for review.

The committee received a copy of a resignation letter from Mr. Consentino on his son Officer David Consentino one dated 08/09/2014 at the 02/24/2015 hearing. The board was still pending a copy of his wife's (Joanne Consentino) resignation letter from her position, as a police dispatcher. The next day the Chairperson Ray Fournier received from Barbara Snicer assistant to the Town
Administrator, another copy of David Consentino's resignation letter dated 09/01/2014, and Joanne Consentino's resignation letter dated 01/26/2015. The Committee requests clarification from Mr. Bill Innes (Town Administrator)on which resignation letter was correct on David Consentino, and was advised to contact the bookkeeper.

The COI committee scheduled another hearing on 03/05/2015 for review of all letters received. Neither the petitioner Mr. Leon Artus, nor Mr. Philip Consentino attended this public hearing.

The COI has voted 4-0, 1 members have recused themselves from the vote. The committee suggests that Phillip Consentino has violated the Town of Atkinson’s Ordinance Section V Prohibited Conduct:
This committee finds: It is a violation of this code for any member to
1. In his or her official capacity as a Selectman, introduce discuss, deliberate, approve or vote upon any matter
in which he or she or any member of his or her family has an interest known to said member being his wife
(Joanne Consentino) who was a police dispatcher at the time of the Selectmen meetings on December
01,2014, and December 15, 2014.
2. As a Selectman, knowingly enter into any discussion, testimony or deliberation without first, publicly and
for the record, stating all dealings, interests, relationships, and possible conflicts that may exist between
said member and his or her family, the principals and the issue under deliberation, as may be known by the
member, who is his wife the police dispatcher (Joanne Consentino).
3. As a Selectman, knowingly participate in town business without disclosing all potential conflicts of interest, with his wife (Joanne Consentino) who was a police dispatcher at the time of the Selectmen meetings on December 01, 2014 and December 15, 2014. The committee does believe that Mr. Phillip Consentino should have stated his FAMILY conflicts publicly, and for
the record, and request if anyone has an issue or opinions on his discussions, deliberation, and voting on Police pay raises as his wife Joanne Consentino was still employed on both Selectmen meetings dated December 01, 2014 and December 15, 2014, and would receive a monetary benefit from this vote. At both Selectmen meetings, he did not recuse himself from voting on any monetary benefits that involved his family.

DISCIPLINARY ACTION:

Pursuant to RSA 31:39a, violating this code shall be grounds for recommending disciplinary action to be taken by the Board of Selectman if found by the majority vote on the Committee.

This is the second violation of the Town of Atkinson Code of Ethics in 2 months, by Mr. Phillip Consentino. The
Board of Selectmen knowingly allowed Mr. Consentino to vote while his family member was employed by Atkinson Police Department. Mr. Consentino was Chief of Police for many years, he should recuse himself as a
Selectmen from any police matters while family was employed, he should also leave the room, until which time the vote has been processed and recorded.

The committee recommends removal of Phillip Consentino, by the other Selectmen, or Mr.Consentino should be allowed to resign.
Failure to comply with Section V Prohibited Conduct, the Conflict of Interest Committee shall petition and file with
Superior Court and retain an Attorney utilizing the Town of Atkinson Legal Line.

Per the Conflict of Interest Ordinance, Section VII, Paragraph G the Selectmen have 45 days from the date finding to act on the Committee's decision. Please see attached Conflict of Interest ordinance.

Yeah! In my town he has my permission to break the laws anytime he wants and we control everything. So keep your state law crap out of our faces. If he wants to vote his wife a raise that's his business. Not some small group of whack jobs to challenge the King! This is his town and it gets run the way he says. So pack your bags CIC sausage heads and MOVE.

Here are new medications for your committee nut jobs. Medicine for nut jobs. Stelazine for schizophrenia. Zoloft for compulsions. Prozac, celexa for depression and delusion.

Best is some good PD shock therapy. I don't mean to threaten you but our PD can bring charges with Jill Cook against you confliict people that will curl your hair tie you up for months till you don't do wrong to the King no more resign and MOVE.
