Hampstead family sues police over chase death

BRENTWOOD, N.H. (AP) _ A Hampstead, N.H., mother is suing police in Hampstead and Atkinson over a chase that ended with the death of her son three years ago.

Gayle Gosselin says officers from both towns violated police pursuit policies in July 2005, when they were trying to stop her son, Chad Gosselin. He was killed when he crashed his motorcycle while trying to get away from officers. Police say he was drunk.

Gayle Gosselin argues officers violated their policies and disregarded safety by chasing her son at high speed through traffic and on a winding road.

I remember this. Story was this guy made a game out of it, luring police into a chase and seeing if he could get away. Hope the judges tosses it.

nope, story was this guy was stopped for speeding, and took off, on East rd. In Atkinson. Officer took off after him up East rd, into Hampstead to Emerson ave, across 111 onto Central ave. where he was going too fast to make the 90 degree turn.

It was reported speeds hit 90mph. Hampstead was mad, that Mutual aid wasn't called for until well after careening through Hamps. for a while.

Women on central ave. reported being woken up by the noise, and seeing cycle go by very fast followed by TWO atkinson cars!

Typical, it's not my dead sons fault for trying to outrun the police, its thier fault. I can hear it now, they should have backed off, they could have gotten the license plate and followed up later, they could have radioed ahead, and on, and on, and on...Did the kid deserve to die, no of course not, but HE chose not to stop. It is HIS own fault. If you don't want the police to chase you, pull over and stop. I'm just glad that no one else got hurt during it.

No doubt the kid shouldn't have run. Ultimately, he owns most of the responsibility for this.

But if there were 1 or 2 police cars CAREENING through residential neighborhoods to catch a kid on a bike that could have easily be found later (color, model, license plate number), then they had NO BUSINESS chasing someone at high speed through a neighborhood.

Too often these chases are driven by too much cop machismo than common sense; get a license plate number (do our cars have dash cams?), and then follow-up later on. A lost life is too high a price to pay for a speeding and driving to endanger ticket for a kid going too fast on a rice rocket.

Think of lawsuit verdicts as just another charity donation from the Atkinson taxpayers...

It's just the Chief's way of giving! What's a few hundred thousand dollars in unnecessary lawsuit verdicts? C'mon, if the people minded the Chief giving away our tax dollars the people would do something about it...

If Atkinson had time to chase the boy with two of their cruisers, they certainly had time to call Hampstead, they were headed right toward the Hampstead Police station. They also shouldn't be chasing anyone outside the town.

If the Atkinson police were traveling near 90 mph, they were endangering themselves, other, including the boy. They should have backed off. They were not drunk yet still showed equally bad judgement.

I hope the mother wins her case. The Atkinson PD and this town do not seem to notice anything is wrong until there's a lawsuit.

FYI - our friends at CNHT.org have been providing updates to the audience on their thursday evening show about Atkinson. They discussed the AGO letters to the Chief thursday nite.

Was the second atkinson cruiser a durango, or blue?

It would be interesting to find out who provided back up for the atkinson officer before Hampstead got there.

Let me see. Police department publishes a "no chase" policy. Bad guys discover that they don't really have to stop. Just go faster than the no-chase policy allows.
Dead criminal = no incarceration costs. We should thank the young man for saving taxpayers' money.
No one should be allowed to sue for any death when the death is that of the person fleeing the police.
It is called "contributory negligence."

What a tragedy for everyone involved. I think it is easy to see both sides of this argument.

If our Atkinson PD chief wasn't generating a lawsuit every week, it wouldn't be such an issue for the Atkinson taxpayers. If he made sure his staff was properly trained, maybe we wouldn't be having this discussion and someone's child would still be alive. Lots of Atkinson PD cars crashing, PD losing guns, certification issues. Sorry, but the chief has no credibility. If I had to pick, I would guess it was the Atkinson PD fault.

There was also a story about the guy from CNHT witnessing an Atkinson Elderly transport vehicle going 80MPH on Route 93. Glad nobody was hurt in that car.

The facts are the facts.

I side with fishgutz as this young man was guilty and brought the problem on himself when he bolted.

So lets say they didn't try to stop him on the first offense and let him continue. Perhaps his recklessness or whatever causes a greater mishap. Later we hear that the parent sue because the officers never tried to stop him in the first place.

Maybe the parents should have brought up the young man to have respect for the law. These folks must be related to the grandfather with the pit-bull that bit the little boy.

They were all speeding and driving recklessly. It could have been the cops that crashed and died and you can bet they would have blamed the boy.

The APD is going to continue to be a safety and financila risk to this town and everyone who passes thru it. I don't know what it will take to get the BOS to take action.

Here it is almost 12 years later and these comments are so off. The Police his the motorcyclist, that's why he lost control. His tire was sent to forensics. Also, the boy could not stop, he tried, but the police were too close to him ( according to three witnesses ) and he literally could not stop with them hitting him, which they did anyway. And by the way, one cop was from Northwood NH working overtime for the town of Atkinson and did not even know the streets of Hampstead, and the second car was a Hampstead Police Cruiser. Let's stop the gossip and everyone thinking they know everything. The deceased young man is not here to defend himself, it is always easier to blame the dead.

The second police car was a Hampstead Police Officer who literally left a party where there was drinking and pot smoking going on and chased the boy on the motorcycle. Hence the Hampstead Police Officer was driving a marked Hampstead Police car. Was this officer intoxicated or perhaps high on drugs? Nobody thought to check him out. People should keep their mouths shut. You do not know the whole story. As a matter of fact, the boy did try to stop but the police vehicles were way to close to him and he COULD NOT stop. Instead, the police cruiser hit him and he lost control of the motorcycle. The Hampstead and Northwood Cop who was working for Atkinson killed the boy on the bike for no reason. There was no reason to stop him in the first place he was not speeding at the time.
