Dear Terry Knowles:

I have received your letter dated August 5, 2008. There are several issues that need to be clarified and I hope I can provide you with the needed information to clarify those issues.

At the present time there are only three (3) accounts that I am involved in, they are the Police Departments Donation/Equipment Fund, the Special Senior Fund and the D.A.R.E. Fund. The Special Senior fund has a total of $30.14 in this account and the D.A.R.E. account has a balance of $33.69. Both of these accounts will be closed out by Tuesday August 12, 2008. The other two (2) accounts that you made mention to do nor exist. The Police Fund and the Life is Not Done Group do not exist.

The Life Is Not Done Group is an organization in town that has donated funds to our Donation/Equipment Fund from time to time and those funds have been deposited into our Donation/Equipment Fund that the town’s bookkeeper has control of. I am not associated or belong to that organization, again the Police Fund you mentioned is unknown to me.

In our conversations you presented me with several ways to properly handle the funds that the residents of Atkinson have so generously provide us with over the past years. One is the one you mention in your recent letter and the other is to put in place an association similar to the ones the Fire Department and the Friends of the Library have. We have opted to go with the formation of an association.



We are in the process of completing the association’s by-laws. When we have completed this task we will be taking advantage of your offer to come to your location so you can review our by-laws and our articles of agreement. Hopefully we will have those documents put together by Monday August 18, 2008. Once we have completed that task I will call your office to set up an appointment to go over our application.

I wish to thank you for your continued support in providing us with the needed information and assistance in helping up set up our new association.

hmmm..they've talked about these funds at Selectmen meetings, in the town report and Chief has donated money from them! He obvuiously has access to the money if he's giving checks to the VGC, to Norika for funding the train trip etc., etc.

You refer to both in the 2007 Town Report!

Remember the Meredith bus trip for seniors?

This is from the selectmen's minutes, August 20, 2007;

To approve the withdrawal of $1,550.00 from the Police Department Equipment Fund. SECOND: F. Childs. VOTE: 3/0/0.

Chief Consentino explained that he would like to donate $765.00 from the Senior Citizen Donation Account to supply a coach for the Senior Citizen’s Foliage Trip to Hart’s Turkey Farm in Meredith, NH on Wednesday, October 3, 2007. The Seniors will then be treated to a turkey dinner during a train ride around Lake Winnipesaukee, thanks to a $1,592.00 donation from the Life is Not Done Committee.

I know for a fact that the $1,592.00 donation from the "Life is not done committee", did NOT come out of the police donation acct. Only the $765.00 for the bus was cut from the donation acct.

Then you have the fact that the Town report gives thanks to the "police depts. life is not done foundation" for providing the turkey dinner on the trip, at a cost of $1,592.00.

So where is the money kept? who is in charge of it? and whose signature was on that check?

This is from page 56 of the 2007 Town Report;

"The Atkinson Police Department's Elderly Affairs and "life is not done yet" Foundation donated the funds for two senior trips(Fall Foliage trip and Beacon Resort Trip) and 11 weeks of Senior Wellness Exercise classes."

Sorry Chief, but NONE of those things were withdrawn through public hearings in selectmens meetings. NONE of those things came out of the PD senior donation acct.

And if you have nothing to do with the life is not done foundation, then why does the town refer to it as the police depts. foundation?

And while we are at it, what is the penalty for soliciting donations for a foundation that "does not exist" in your own words?

Co incidence that when people are looking at comments in the town report with regard to improper or perhaps illegal activity on the chiefs part, the Town report disappears form the town website?

Well not to worry, we will get that town report posted again.

This was done by the Chief or someone close enough to him to be willing to take a chance at getting caught. I suppose they would just refuse to prosecute if they got caught anyway. Isn't that how they squash the other crimes they commit around town?

Ask the BOS, they'll tell you how to threaten people then avoid getting arrested for it.

This reminds me of Wayne Peak, about 30 years or so ago. He questioned the chief about some money that he took in without giving it to the town bookkeeper, and he was harrassed to no end, and for what? The lawsuit went on for years and they Town settled with him.

Did anyone see the Chief of Police standing out in front of the cemetary tonight? I drove by him just standing there staring at every driver going by him. His arms behind his back and in full uniform with his son in the police car behind him. This sight i have never seen before, It looked creepy. I mean Creeepy looking.
What was going on ? Does anyone know?

No "Life is not done"? Why is it i have heard this account from the chief's mouth on TV? How can someone outright lie like that to the Attorny General? What a disgrace to Atkinson, the Chief has gone way too far.

I'm trying to figure out why anyone with half a brain would send a letter like this to the NH AG under these circumstances. Now he'll really get them interested. Written letters. Good evidence. I really think this guy is losing it because I can find no logic in his actions.

Do the Selectmen authorize him to send these letters and speak on behalf of the town? Do they review the letters first? Maybe they are just letting him sink his own ship?

The AG office must be passing around this letter and getting a good chuckle.

I dont know for sure but it seems like everytime he is getting really bad press he finds a way to be out in public in full dress uniform.

Showing the colors, gangs call it.

Remember him getting guff from Acciard over that idiotic certified letter? He was in the selectmens meeting in full dress, right behind the table in full view.

remember when the officer lost the gun? he was acting as school crossing guard in his whites.

I am not the Mercedes Benz owner who posted before on this blog. Today at 7pm I reported the theft of a hub cap from my antique 1972 Mercedes 280SE 4.5. This theft or vandalism occurred Saturday night or early Sunday morning as I detected it late in the day Sunday. Mr. Consentino, offier Butler and another officer came to my residence after 7pm this evening to examine my vehicle and make a report which I will pick up tomorrow (Tuesday, August 19th). I find it curious that all four original hubcaps remained on this antique for 36 consecutive years. Am I to assume I am just "unlucky"? -- Gary D. Brownfield

Mark, the attack on your car crosses the line, once again.
Did you have the state police dust for prints? This is not just simple vandalism.

Then the Chief stands out by the street staring down residents. Letting everyone know he is above the law. Why else would he write a letter to the AGO denying a fund exists when there are records showing he clearly knew of and had direct control of.

You have been to most open about standing up. You have paid very near the biggest price for doing so. He is hoping to that your family will give up and move. Why else would those messages be on you family car?
Hang tough. Vindication will come.

Mark, I am so very sorry for this awfull attack against you and your family. This attack against you and your family is horrible. Why someone would take it to that level , i will never understand. I agree with Fishgutz , the state should be involved. The State Police should be called now to do the investigation.
This issue is very Troubling.....

What most people don't realize is that we are losing property value because of our corrupt town.
Some people that have tried selling their home have heard prospective buyers say if the home was not in Atkinson they would buy.
I can't believe how awful things are. Or should I say how we as residents have allowed it to come to this.
More power to Mark and I hope he gets 10 million. Maybe then the "townies" will see their mistakes!

Politics get personal Town critic's car vandalized over the weekend

ATKINSON, N.H. — An outspoken critic of selectmen and the Police Department reached a breaking point over the weekend when his car was vandalized.

"My focus now is just fixing up my house and getting out of town," Mark Acciard said yesterday.

Acciard said he awoke Sunday morning to find every panel of his 2006 Chrysler 300 keyed with messages about his $3 million civil lawsuit against the town and three officials, as well as references to his continuing feud with police Chief Philip Consentino. The vandalism took place during the night.

"No $" and "3m no way" are scratched into the trunk, Acciard said. "Leave the chief alone" runs down the roof and onto the hood of the car, he said. "Move" is keyed into the hood and the driver's door, he said.

The key marks are scratched deeper than the paint, leaving messages in white on the black sedan, he said.

Acciard, a former Budget Committee member, has long tangled with Consentino, trading accusations and lawsuits as far back as 2004.

In January, Acciard filed a $3 million lawsuit against the town, Consentino, Moderator Frank Polito and former Selectman Jack Sapia for incidents he said occurred at selectmen's meetings over a three-year period. Acciard claims he was defamed during some of those meetings. A trial has been scheduled for June.

The town often is divided between Consentino supporters and detractors, with Acciard among the more vocal opponents of the longtime chief. The two often have clashed publicly. Acciard has made numerous conflict-of-interest complaints against both selectmen and the police chief.

But the vandalism to Acciard's car is the first physical evidence that points to the high degree of animosity between the two factions in town.

Consentino appeared to be surprised to hear references to him were scratched into Acciard's car.

"I haven't heard any of that," Consentino said yesterday. "The officer out there said he could see 'no way' and 'no money.' I haven't seen the car."

Officer Vincent Scarvaglieri responded to Acciard's home at 6 Christine Drive on Sunday morning and took photos of the car, Consentino said. Because of glare from the sun, the pictures didn't come out clearly, he said.

Consentino did say Scarvaglieri wrote in his report that every panel of the car, including the roof, was damaged. But Scarvaglieri wrote that the language wasn't clear and he could only make out two phrases, "no way" and "no money," Consentino said.

Acciard said he does not believe Consentino was involved in the damage to his car, but he would like New Hampshire State Police to handle the investigation because references to the chief were part of the vandalism. Acciard said he told Scarvaglieri he wanted state police called in.

But Consentino said yesterday his department will handle the case.

"If he wants to go to state police and have them come down, it's his prerogative," Consentino said.

Acciard said he asked selectmen last week for some extra police patrols in his neighborhood because his house was getting egged every couple of months, including recently.

Consentino said officers already check Acciard's house once or twice a shift for vandalism because of the complaint. The extra patrols started just over a week ago, he said, and during that time there has been lots of egging on Christine Drive, Walker Road and Meditation Lane.

Consentino said his department has put in extra effort and Acciard was getting more attention than others in town. But he did agree the vandalism to Acciard's car was much worse than the egging.

"I'd say that someone has a personal vendetta against him," Consentino said. "He probably has a couple ideas of who it could be, but I can tell you it's not any of those people."

As of yesterday, Acciard hadn't called state police. He had made several phone calls to his insurance company to see if it would pay for the damage.

Re: Phil's reply to the Attorney General suggests a Police Association similar to the Fire Department and Friends of the Library.

I don't ever remember seeing the funds of either organization listed on the Trustee of Trust Fund Reports. Would that mean that, if they form an Association, they will not be subject to the same state laws? And wasn't there a Police Association (which accepted donations) when Wayne Peak first raised his questions?
Are we going backwards?

The AGO's office said that they are not sure what the Chief is going to suggest at this time. If it's a non-profit such as the Friends of Kimball Library, it will be registered with the State and operated in the open and file reports with the AG. If donations exceed a certain amount they also have to file reports with the IRS. This information, along with a list of all legal charitable orgs can be found at:
