ATKINSON, N.H. — An outspoken critic of selectmen and the Police Department reached a breaking point over the weekend when his car was vandalized.

"My focus now is just fixing up my house and getting out of town," Mark Acciard said yesterday.

Acciard said he awoke Sunday morning to find every panel of his 2006 Chrysler 300 keyed with messages about his $3 million civil lawsuit against the town and three officials, as well as references to his continuing feud with police Chief Philip Consentino. The vandalism took place during the night.

"No $" and "3m no way" are scratched into the trunk, Acciard said. "Leave the chief alone" runs down the roof and onto the hood of the car, he said. "Move" is keyed into the hood and the driver's door, he said.

The key marks are scratched deeper than the paint, leaving messages in white on the black sedan, he said.

Acciard, a former Budget Committee member, has long tangled with Consentino, trading accusations and lawsuits as far back as 2004.

In January, Acciard filed a $3 million lawsuit against the town, Consentino, Moderator Frank Polito and former Selectman Jack Sapia for incidents he said occurred at selectmen's meetings over a three-year period. Acciard claims he was defamed during some of those meetings. A trial has been scheduled for June.

The town often is divided between Consentino supporters and detractors, with Acciard among the more vocal opponents of the longtime chief. The two often have clashed publicly. Acciard has made numerous conflict-of-interest complaints against both selectmen and the police chief.

But the vandalism to Acciard's car is the first physical evidence that points to the high degree of animosity between the two factions in town.

Consentino appeared to be surprised to hear references to him were scratched into Acciard's car.

"I haven't heard any of that," Consentino said yesterday. "The officer out there said he could see 'no way' and 'no money.' I haven't seen the car."

Officer Vincent Scarvaglieri responded to Acciard's home at 6 Christine Drive on Sunday morning and took photos of the car, Consentino said. Because of glare from the sun, the pictures didn't come out clearly, he said.

Consentino did say Scarvaglieri wrote in his report that every panel of the car, including the roof, was damaged. But Scarvaglieri wrote that the language wasn't clear and he could only make out two phrases, "no way" and "no money," Consentino said.

Acciard said he does not believe Consentino was involved in the damage to his car, but he would like New Hampshire State Police to handle the investigation because references to the chief were part of the vandalism. Acciard said he told Scarvaglieri he wanted state police called in.

But Consentino said yesterday his department will handle the case.

"If he wants to go to state police and have them come down, it's his prerogative," Consentino said.

Acciard said he asked selectmen last week for some extra police patrols in his neighborhood because his house was getting egged every couple of months, including recently.

Consentino said officers already check Acciard's house once or twice a shift for vandalism because of the complaint. The extra patrols started just over a week ago, he said, and during that time there has been lots of egging on Christine Drive, Walker Road and Meditation Lane.

Consentino said his department has put in extra effort and Acciard was getting more attention than others in town. But he did agree the vandalism to Acciard's car was much worse than the egging.

"I'd say that someone has a personal vendetta against him," Consentino said. "He probably has a couple ideas of who it could be, but I can tell you it's not any of those people."

As of yesterday, Acciard hadn't called state police. He had made several phone calls to his insurance company to see if it would pay for the damage.

I do hope the BOS is not insane enough to appoint any current Phil Puppet to replace him when he eventually leaves.
And I hope Mark wins big in his law suit.
The town deserves better than an over grown two year old as Chief.

I'm so glad that Mark's story made it to the front page, it was a horrible thing to happen; but now others will see what goes on in this town when you go up against consentino. Must be thousands of dollars of repairs he's looking at. Then I turn the page and see consentino looking like a buffoon. I'm sorry but that man is an embarrassment to this town, just look at him!
Mark I hope this works out for you. I for one doubt that our police will do a damn thing about it.

Today's Eagle Tribune has a picture of the badly vandalized car and this is obviously a politically based crime. Don't miss page 3 of the same paper for a beauteous picture of the Atkinson Chief at the Atkinson Country Club on Sunday receiving accolades and wearing a kingly crown. Which new hidden illegal donation fund paid for that event? Which illegal fund paid for the vandalism? "Drive 'em Out of Town Now" fund?

We must have the greatest police chief ever. He already rounded up the usual suspects and can assure us that "it's not any of those people"...

Or else he may know who did it and knows no one would suspect this person.

Looks like some young punk or some old drunk. Either way, they had outside influences. Now round up the usual suspects with vendettas and see if they know any punks or drunks.

Hey Mark. I can't believe this happened to you. I know you are (justifiably) angry and upset over this, but I hope you change your mind, reconsider, and stay in Atkinson. Although I don't agree with your points of view all of the time, Atkinson needs people like you.

Nothing like a little incident like this to take some of the attention away from the fact that the AGO sent "The Chief" a letter saying he is breaking the law, eh?

It's tough to see in the paper how PC really feels about this, but you would think he would -- at least -- have a statement saying this is wrong to do and will not be tolerated.

I was actually very encouraged to see the that after only a couple of days, the Chief has already interviewed suspects, and corroborated alibis.

I was so relieved to find out that it wasn't any of the people that I thought it was!

But who WERE those people, Chief, because I haven't blamed anyone? And how EXACTLY do you KNOW it wasn't any of them? And, while we are at it, How the hell do you presume to know what I am thinking?

In the August 15 ET article on the break-ins in Hampstead and Atkinson, Chief Consentino is quoted as saying, "This is the closest thing we've had to crime in Atkinson."

Chief, THIS is a crime, and a serious one at that. Let's see how you perform. Set your feelings aside and do your job. We're watching...closely!

Now i have a pretty good idea why the cheif was out standing on rt 121 last nite. Looking like he was doing something, for everyone to see driving home from work, standing there.....Am i missing something ?

Mark, it's time to call the FBI. Your civil rights are being infringed up. This kind of harassment is a felony. You will not get help from local law enforcement or the state.

It's clear local law enforcement is nothing more than organized crime. I can't say I'm shocked. I've met most of the players and they look more like criminals than heroes.

Negative results? Seems he has been one of the few trying to improve accountability in Atkinson, and it will be a tremendous loss to the town if Acciard leaves.

Nobody is accusing him of this particular attack, but Constantino has created and nurtured the divisive atmosphere where such childish lashing out at critics is acceptable.

And your offsetting of "right vs. happy" makes it sound like you advocate letting corrupt and incompetent people get away with it as long as you don't have to get off your couch.

Every town around here could use somebody like Acciard. It's the lack of people like him that has contributed to all the pension fraud and every other scandal filling the papers.

This chief he is a real package he is right where he belongs in New Hampshire. It also sounds like Scarvaglieri is another prize. Because of the glare from the sun the pictures did not come out clearly, and this guy is a cop? Hint - go later in the day the sun goes down or have Consentino buy you a real camera. Mr Acciard
you should really consider having cameras installed around your house for some sort of protection, because it sounds like your house is not on the coffee route and they have to make a slight detour to keep an eye on a taxpayer.

I live in Atkinson and this guy just needs to leave. Hes causing all kinds of trouble over nothing and just being ridiculous. He doesn't deserve 3mil $ for being "defamed", and he should just pack up his things and leave already. And by the way, the police aren't the ones causing the trouble, I know them personally, they are just doing their jobs and minding their own business while this guy thinks he owns the place.

What kind of evidence do you want them to go off of.....are they gonna match the key to the keyed car? no....Some kid (not me btw) came in the middle of the night keyed his car and left. there is nothing that they can physically do to find who did it. It would be a complete waste of $.

Just because you want the town to be corrupt, doesn't mean it is. The above article is almost completely biased towards Accaird and does no justice for the town itself.

Wow - no denouncement of the vandalism from Constentino! At least in the included quotes, he expresses no concern whatsoever for the Acciard family, but instead trivializes the incidents. What a piece of work. Maybe Acciard has the right idea to move.

$3mil is alot of money and I am sure not everybody knows all the inside details, but people need to leave this guy alone.

Atkinson? That town may have some corruptions here and there and I am in no means baggering the town itself, but certain people who run it.

I grew up in one of the least greeatest cities and it is more corrupt for sure.. haha

Ok so heres my opinion Keying someones car is a serious offense.
Theres no need for this childish behavior. I am not a fan of Mr. Acciard . I think he goes way to far to bash the Atkinson Police.
But there is vandalism everywhere so when someone says where were the police when this incident happened really upsets me because obviously they can not sit at Mr. Acciards house every evening all evening. Had he heard something and reported it and they did not respond in a timely manner .thats when I would say where were the Police. But this is not the case from what i understand he found this in the morning. so really Lets not make this a place to start bashing the Atkinson PD.

That car has a warning carved into it that says "LEAVE CHIEF ALONE". That vandal started this on the Chief's behalf, so the PD are involved by default. This was serious, not childish.

Acciard did nothing to deserve this, no one deserves this for having different politcal opinions and affiliations. We have rights as citizens to question anyone in office when they are threatening people, misusing assets, and engaging in corrupt behaviors and racketeering. We have the right to question officials when they're NOT doing anything wrong. We own them, they work for us.

They should have called the State Police to handle this and stepped aside since there is an obvious conflict of interest.

I disagree with Acciard's opinions quite often - not quite as often as with Constantino, but often enough. A big difference between the two is the respect for the process, law, courts and the citizens of Atkinson that Constantino seems to lack.

Every embarrassing news story about Atkinson and most town lawsuits and settlements center around Constantino - he's a one-man legal and financial calamity. Other towns in the area have their more than their share of problems, but nowhere else do they center around a single person.

Acciard is the victim here, that inflated joke of a police-officer-without-a-gun refused to call in the State Police when a person he is involved in a lawsuit with, gets vandalized. Do you really think he will be objective? Take evidence? Don't you think this will count against him in court? This is the essence of conflict of interest and will be worth another couple of million dollars.

Get real....Phil Consentino is an AH and he is abusing the system, even in NH. He is the worst excuse for a police chief that has ever walked the streets of NH and I look forward to the day that he drops off the payroll.

Did you notice that there are no police log entries this w/e for Atkinson? Don't you wonder why the town doesn't put anything in the paper? This man is a floundering idiot and is going down. yeah....it's the same guy. The AGO said he's running illegal funds....you know...he collects money from the elderly and puts it in an illegally run fund and gives money to whomever he pleases. Scum bag. Has he been fired? Charged? No. DON'T MOVE HERE.

We don't vote him in, he's forced upon us by the BOS who do not fire him. He has not been appointed since '99 but here he is....Each year we vote in someone who we hope will be good for the town but this obviously hasn't been working for us.

We will be happy to hear any ideas on how to oust him. The NH AGO is not listening, the State Police have no juristiction, the BOS are probably on the take too. WHY would anyone in their right mind deal with the loser out of preference?

So did you live at the drug house on Stage Rd. that he refused to close down in the 90's? He said he couldn't arrest anyone there unless he saw them breaking the law. His own cops said they couldn't arrest anyone without his personal OK. The town of Atkinson took hundreds of complaints from residents about drug sales, guns, prostitution, health code violations, threats, vandalism....you name it...he refused to do anything. How many people had to move to get away from this when he refused to do his job?

How many houses has he entered after being dropped off by his officer, while seemingly no one was looking? Was it for drugs? Was it for a nooner? Do you know what information is about to come out about these clandestine meetings?

How many people will take the town to court before the BOS and the residents figure out that there is only one common denominator?

I cannot believe that the police department would behave in this manner. That is cruel and a terrible thing to do to a citizen regardless of the reasons behind it. NH law is a joke and I am glad I move out of New England completely. Best of luck to Mr. Acciard, and y es, please move out of the New England area. NH and MA are the most sarcastic and unkind people in history. You won't realize this until you actually move out of the state and see how there are better states and kinder people out there. Yes, leave the darn state and make a better life for yourself. Good Luck Mr. Acciard.

I don't know you well, have never met you, but I have great respect for you. I saw the youtube video from 2005 where you stood up to the chief about spending the vehicle money w/o a proper town vote and they gaveled you down. You were not dealing in personalities, you were standing your ground on the law.

I hope you will stay and fight this.

It is inconceivable to me that the investigation would not be handled by the state police or attorney general's office, under the circumstances.

I was amazed at the ET blog comments about you being a troublemaker. It is the people who refuse to do things in compliance with state laws, in your town and mine, who are the troublemakers. If people would just make the least effort to read and follow the laws we would get stuff done in our towns more efficiently and with much less fighting.

As a 41 year resident of Atkinson, it pains me when anyone feels they can not speak their mind or criticize their government in any manner they so choose, without the fear of retribution. Speaking as one who saw the Soviet threat first hand, I have never been able to stomach the need to stifle any factual observation about the conduct of government.

It is absolutely horrible that your vehicle was vandalized, but the terrible truth of the matter is, that it is vitually an unsolvable crime. Without anyone witnessing anything (a vehicle leaving the area, a description of a suspect, even hearing something to narrow down the time frame) there is nothing law enfrocement can follow up on, be it APD, NHSP, or the FBI; it is sad but true. Yes you can have your hunches as to who it could have been, but it is a long way from a hunch to an arrest, and with no leads, it is virtually impossible to get there.

Shows like CSI have given the vast majority of people some sort of false hope that law enforcement has all these magical tools to solve every crime, when the reality is far from that. Generally speaking, the only way crimes like this get cleared is if someone saw it happen, or the suspect starts bragging about it. I honestly feel for you, and I agree with anon at 5:03 that you should get some exterior cameras to watch over your property. They are pretty small and can be cleverly disguised. I also agree with anon 4:29 that Atkinson needs you. Keep up the good fight as long as you can.

Unfortunately, we all likely know where this is going; most of the people in Atkinson are uninterested sheep that are happy to pass through life ignorant of the shortcomings of our local leaders; that will likely insure that not much happens here.

I will celebrate when this is not true, but if they haven't smartened up in the past, this will make little difference.

I think Atkinson Town's people are missing the BIG PICTURE of this act of vandalism.

1. Let’s say you have a problem in town, around the town, with the town, because of the town, so you go
to the BOS and complain.

2. BOS say the will get back to you and don't.

3. You continue to complain, and they blame you for the problem.

4. You continue to complain, and they label you a troublemaker.

5. You try to find another way to fix the problem, and BOS/Planning board/ZBZ/PD, all throw stumbling
blocks in your way.

6. You consult an attorney to find our your rights and file a complaint with the legal system.

7. PD finds out about it and does everything they can to block it.

8. BOS tells you it's a civil problem and they can't do anything about it.

9. You file a legal suit and get labeled as having a personal vendetta against BOS/Planning board/ZBZ/PD etc.

10. You pay legal fees while the BOS/Planning board/ZBZ/PD get free legal fees paid by the taxpayers.

11. You amass enough proof and get the AGO'S office to intervene.

12. BOS/Planning board/ZBZ/PD gets very worried and mysteriously your car gets keyed, house gets
egged repeatedly.

13. You file a complaint with the PD, and Chief states the he won't bring in the State Police and you must
have someone with a personal vendetta against you. You're the problem, not anyone else in town.

14. You get slandered/libeled by the BOS/Planning board/ZBA/PD on TOWN RUN Act 20 TV at their
meetings.

15. BOS/Planning board/ZBZ/PD go to the Country Club after meeting and have a good laugh about it, at
your expense.

16. You file suit against them, and they call the town attorney to handle the mess they created.

It's the revolving door the BOS/Planning board/ZBA/PD have used for the last 40+ years and it has worked for them. They will continue to use it, until you stop them.

Just how far will they go, to not give up their power?

Let's say you have a great case and are beating them in court. How upset will they get?

Will you

1. Wake up one day with a bloody horse head in bed with you or
2. One of you kids get abducted, or
3. Someone in you family get shot and killed or
4. Your house gets fire bombed or
5. You and your family have to go into the witness protection program?



Just how far do you believe the "Atkinson Mafia" will go to keep you from exercising your rights as a citizen of your town? Do you really want to know?

This is far more serious than the people reading this blog seem to understand. This mode of operation by the local authorities is nothing more than Mafia tactics, protected by the guise of law enforcement/Chief CONSENTINO.

The "Atkinson Mafia" has infiltrated every part of your local government, and using that system to take your rights away. Until such time that you the people take Town Moderator/BOS/Planning board/ZBA/CONSENTINO out of office, along with all their cronies, they will win every time.

It's time to continue strengthening your committees / organizations, until you out number them. You need those lawbreakers out of office and moved out of your town. (Hopefully jailed) You need to find a way to take their paid legal fees away, and you need to end the revolving door. You need to take your town back.

For the record, I am not expecting miracles. The reason I asked for the State Police to investigate is, as I told Lt. Baldwin, and Selectman Sullivan, that it would be the best thing for both Atkinson, and the Police Dept.

If I were the chief or LT. I would have called them up front. Because regardless of the result of the investigation, and yes, The results will probably be the same no matter who investigates, the public perception will be different.

Why would anyone want to put themselves and their work in a position where people can ask integrity questions, when it is so easy to avoid that situation?

I told Lt. Baldwin that I had faith in he and his men to handle this professionally, but I thought it would be better for all involved if they passed the buck.

EVERY TIME there is controversy in Atkinson, and it makes the papers, it ALWAYS centers around Phil!

The people questioning him, the names change every few years, but it is ALWAYS Phil at the center of the firestorm, and he is ALWAYS claiming that his antagonists have a "vendetta" against him.

Most of the time I disagree with the way you present your case. But I do feel for your children who have to witness this craziness. Nobody should be subjected to this. I would suggest
you do have video cameras installed.
they make them so small now a days you wouldnt even know they exist. sometimes you have to ask yourself is this really worth the safety of my family. I dont believe the chief would put anyone up to this ..but that would just be my opinion. I do believe there are some pretty crazy people living among us.... Atkinson resident

How about "Town Hero" for being the only person in town to have the BA--- to stand up to this flaming ass---- chief we have.

I agree with posterAugust 20, 2008 11:30 PM. However even though the chief may have not done this, the two (the chief and the vandals) certainly know each other. The proof is in the writing on the car.

With that said, eventually there will be a parlor room confession due to pride of the vandals. Will the chief at that point make an arrest or will he be an accessory to the crime? The chief would not arrest a good friend would he?

Thank you all, for your support, and just to keep the record straight;

The State Police DID start an investigation today.

I did not call them so, I presume that the Atkinson Police Dept. did. Thank you, Chief, and Lt., it really is better for everyone for this to be done outside town.
